One of the nagging issues in the run-up to the Copenhagen climate summit are demands that the US and Europe provide massive aid so poorer countries can buy expensive emissions-free technologies. Activist David E. Martin claims many of the patents for today's low-carbon technologies -- including some used in wind power and hybrid cars -- are already in the public domain.

When the host of a party predicts a flop, it rarely inspires much confidence in a good bash. With just over a month to go before international climate talks start in Copenhagen the Danish government has done exactly that: Don't hold your breath, it said, it's unlikely there will be a binding global deal. European Commission President Jose Manuel Barroso had even stronger words earlier this week: "Of course we are not going to have a full-fledged binding treaty, Kyoto-type, by Copenhagen. There is not time for that."

Money is threatening the fight against climate change. Climate experts have priced emissions-cutting technologies needed by developing countries at €100 billion ($149 billion) a year starting in 2020, and they want to see about half of that investment burden shouldered by public funding from the United States, the European Union and Japan. The world's poorest countries warn that without a solid promise of funds, they will walk out of the Copenhagen summit. But €50 billion is more than the loose change European states, Washington and Tokyo are willing to dole out -- particularly after bailing out their banks. European leaders meeting in Brussels last week shirked concrete commitments, saying only they would contribute their "fair share" to upfront climate financing.

Need It Be that Expensive?

David E. Martin is travelling the globe to prove negotiators wrong about the cost of battling climate change. He's not making himself very popular. It's not that the 42-year-old patent expert denies global warming. It's that he says designs for green gadgets, from hybrid cars to wind turbines, are now in the public domain and freely available -- if you know how to find them. As executive chairman of innovation finance firm M-CAM, Martin has made it his life's mission to make sure an increasing number of people, companies and countries have access to this information. Most recently, in collaboration with the World Bank's Information for Development Program, he launched an online database of gadgets whose lapsed patents in advanced energy, water and agricultural technologies represent potential license savings worth, according to the World Bank, more than $2 trillion.


To big business, Martin is a nuisance because he questions the very validity of some of the vast profits expected from a new climate deal. To governments, his truth is inconvenient because it threatens a delicate relationship with corporate giants they want backing their climate goals. For Martin, it's a continuation of his interest in what he calls linguistic genomics - the study of how the meaning of words shifts and changes, and how this can be used to obscure meaning and gain an advantage. Patents, he says, keep getting issued because even though they cover the same ground, they're worded in different ways. So car brakes that charge an electric car become a "regenerative brake device having a driving wheel, an electric motor and a battery," or a wind turbine becomes "a power house and vanes rotating in the wind." The more complicated the wording, the more likely that a patent will be granted. Indeed, it can take a patent expert up to three days to assess two three-page patents for overlapping claims.

Trawling Patents

Martin first grappled with the many meanings of words when he was five years old. Back then, in southern California, he huddled over the family kitchen table with his mother and three brothers, translating ancient Greek into a version of the English Bible that is now in its fourth edition. Thirty-odd years and several natural disasters later, he is trawling environmental patents for double meanings, just as he once trawled religious texts. As he sought to do with his childhood Bible text, he is trying to shed light on weighty issues -- only this time it is not about the foundations of faith, but about how much developing countries from China to Tanzania should have to pay in the fight against global warming. His custom-made software and a vast server are programmed to trawl and compare hundreds of thousands of files containing patent information from what would seem an incongruous list of places: Papua New Guinea, Berlin, the Brazilian rainforest, New York. Some of these patents are new; others have expired. What Martin -- and those who work with him at M-CAM -- say they found is that one in three patents registered today on energy-saving technology duplicate gadgets that were first dreamed up in the wake of the 1970s oil crisis and are now freely available.

With his unpopular data and promotion of free technology that is legally available in the effort to slow global warming, Martin's work tracking illegal patent claims has made him an army of foes among big business, patent examiners and even climate negotiators. "I've lost count how many times people have threatened to hurt me and my family," Martin told SPIEGEL ONLINE in a phone interview. "It's because I'm talking about a truth that is inconvenient."

That hasn't stopped him. He has testified before the US Congress and butted heads with patent offices worldwide. He is contributing to the emerging drive by the World Bank's International Finance Corporation and members of the European Parliament to make this truth known. His clients include the US Treasury and Commerce Departments and his work inspired the Swedish activist project The Patent Bay, which analyzes the validity of patents in Europe to promote innovation.

Yet negotiators still largely hold on to the sense that patent licenses are fundamental to encouraging green innovation. To avoid hostile debate, climate negotiators hope to use part of the €50 billion for payments to patent holders, even if their patents may be redundant.

De Commissie Brinkman 3


De Commissie Brinkman schrijft zijn rapport onder het motto: ‘The world we have to deal with is out of reach, out of sight, out of mind. It has to be explored, reported, imagined.’

Opmerkelijk is dat dit citaat foutief is, zoals een lezer me net liet weten. Ik heb opnieuw het origineel gelezen en inderdaad, in werkelijkheid staat er op pagina 31 van Public Opinion in de uitgave van Filliquarian Publishing: 'The world we have to deal with politically is out of reach, out of sight, out of mind. It has to be explored, reported, imagined'

De reden waarom de Commissie Brinkman het woord 'politically' heeft weggelaten is nogal voor de hand liggend. De Commissie Brinkman doet aanbevelingen voor de politiek, werd betaald door de politiek en moet de politici dus ontzien. Maar toch wilde men een beetje belezen uit de hoek komen, en dus een fout citaat. De corruptie in Nederland strekt zich ook uit tot de moraliteit. Het draait hier alleen nog maar om geld, subsidies, socialisme voor de rijken.

Inge Brakman van Fortis

In het begin van de jaren tachtig volgde ik langere tijd de kongsi van banken, onderwereld, huisjesmelkers, corrupte notarissen en ander tuig dat geld verdiende aan de schrijnende woningnood. Op een gegeven moment werd de geluidsbandenbibliotheek van STAD/Radio Amsterdam 's nachts in brand gestoken door mensen uit dit wereldje die mij eerder hadden bedreigd met van alles en nog wat als ik niet mijn onderzoek staakte naar de praktijken van de kongsi. Follow the money en je komt veel te weten.

Ik moest aan deze gouden regel denken toen ik vandaag zag wie in de Commissie Brinkman zat. Neem bijvoorbeeld de volgende dame:

Inge Brakman was tot 1 april jl. voorzitter van het Commissariaat voor de media, de toezichthouder voor de publieke en commerciële omroepen. Zij is tien jaar aan het Commissariaat verbonden geweest. Daarvoor werkte ze voor de Nederlandse vereniging van Journalisten (NVJ) als CAO-onderhandelaar, begeleider van fusie en reorganisatieprocessen bij dagbladen en omroepen en specialist persvrijheidzaken en auteursrechten. Zij is commissaris bij Fortis Bank Nederland, en toezichthouder bij de Universiteit van Amsterdam en het opleidingscentrum de Baak VNO-NCW.

Follow the moneytrail en je komt altijd wel bij een bank terecht, in dit geval Fortis. Fortis? Ja, deze Fortis: 'In september 2008 meldde Fortis dat het haar deel van ABN Amro Bank weer wil verkopen. Er werd echter geen koper gevonden. [1] [2] [3]. Op 4 oktober 2008 maakt de Nederlandse regering bekend dat het alle Nederlandse onderdelen van Fortis, inclusief ABN AMRO, heeft overgenomen voor € 16,8 miljard. In dit pakket is ABN AMRO het grootste onderdeel. ABN AMRO en het Nederlandse deel van Fortis zullen worden geïntegreerd en op termijn worden verkocht of naar de beurs worden gebracht. [4]

Blijft over de vraag: wie heeft de Commissie Brinkman samengesteld? In Nederland heerst het poldermodel, waarbij ons kent ons, en de zaakjes via cooptatie worden geregeld, zodat 1 ding goed duidelijk blijft en dat is -- in de woorden van Walter Lippmann, tevens de opiniemaker die de Commissie zijn motto gaf --"The public must be put in its place," het gevaar loert namelijk overal en daarom: 'Access to the real environment must be limited, before anyone can create a pseudo-environment that he thinks is wise or desirable.'

Brakman was 'tien jaar aan het Commissariaat verbonden geweest. Daarvoor werkte ze voor de Nederlandse vereniging van Journalisten (NVJ) als CAO-onderhandelaar, begeleider van fusie en reorganisatieprocessen bij dagbladen en omroepen en specialist persvrijheidzaken en auteursrechten.' De Inge Brakman's van deze wereld zijn multi-inzetbaar.

Wat bedoelt de Commissie hier precies mee? Wel, laten we allereerst kijken binnen welke context Lippmann het bovenstaande beweerde. De zinnen die volgen op deze: ‘The world we have to deal with is out of reach, out of sight, out of mind. It has to be explored, reported, imagined’ luiden als volgt: 'Man is no Aristotelian god contemplating all existence at one glance. He is the creature of an evolution who can just about span a sufficient portion of reality to manage his survival, and snatch what on the scale of time are but a few moments of insight and happiness. Yet this same creature has invented ways of seeing what no naked eye could see, of hearing what no ear could hear, of weighing immense masses and infinitesimal ones, of counting and seperating more items than he can individually remember. He is learning to see with his mind vast portions of the world that he could never see, touch, smell, hear, or remember. Gradually he makes for himself a trustworthy picture in his head of the world beyond his reach.'

En dat laatste nu werd door Lippmann als een groot gevaar gezien. Wanneer ieder individu een eigen beeld van de werkelijkheid zou kunnen vormen dan zou er onvermijdelijk chaos ontstaan. Een massamaatschappij is per definitie totalitair. Alle neuzen moeten dezelfde kant op staan en daarom moesten 'public opinions be organized for the press if they are to be sound, not by the press... Without some form of censorschip, propaganda in the strict sense of the word is impossible. In order to conduct propaganda there must be some barrier between the public and the event. Access to the real environment must be limited, before anyone can create a pseudo-environment that he thinks is wise or desirable.'

Immers: 'How small our proportion of direct observations is when compared to those observation that are conveyed to us through the media.' Om nu te voorkomen dat de massa, in de woorden van Lippmann 'a bewildered herd' op hol slaat, moeten de beelden die de massa krijgt toegediend streng geselecteerd worden, zodat de juiste opvattingen ontstaan 'for the real environment is altogether too big, too complex, and too fleeting for direct acquaintance.' De massamens 'is not equipped to deal with so much subtlelety, so much variety, so many permutations and combinations. And although we have to act in that environment, we have to reconstruct it on a simpler model before we van manage with it.'

De massa moet een vereenvoudigde voorstelling van de werkelijkheid voorgeschoteld krijgen die de belangen van de elite voor wie Lippmann schreef niet bedreigt, dat spreekt voor zich. Het zal niemand verbazen dat de Commissie Brinkman deze zinnen wegliet. Want in navolging van Lippmann adviseren de Commissieleden steun aan de commerciele massamedia die er zorg voor moeten dragen dat "The public must be put in its place," zodat we "live free of the trampling and the roar of a bewildered herd," wiens enige "function" is niet meer dan"interested spectators of action," te zijn en zeker geen deelnemers. De commissie heeft in opdracht van de Minister van Onderwijs, Cultuur en Wetenschap advies uitgebracht over innovatiemogelijkheden binnen de pers en over de toekomst van nieuws en opinievoorziening in Nederland, toegespitst op de rol van de pers. In het adviesrapport "De volgende editie" heeft de commissie haar bevindingen uiteengezet en doet zij aanbevelingen.

Aangezien ik het werk van Walter Lippmann heb gelezen weet ik wat deze vooraanstaande Amerikaanse opiniemaker precies bedoelde. Dit bijvoorbeeld: "The public must be put in its place," zodat we "live free of the trampling and the roar of a bewildered herd," wiens enige "function" is niet meer dan"interested spectators of action," te zijn en zeker geen deelnemers.

Nog een citaat uit het werk van Walter Lippmann: 'public opinions must be organized for the press if they are to be sound, not by the press... Without some form of censorschip, propaganda in the strict sense of the word is impossible. In order to conduct propaganda there must be some barrier between the public and the event. Access to the real environment must be limited, before anyone can create a pseudo-environment that he thinks is wise or desirable...'

En hier wordt meteen duidelijk wat de Commissie Brinkman in feite bedoelt, namelijk niet iedereen kan worden toevertrouwd opiniemaker te zijn. Dat kunnen alleen degenen die binnen de grenzen van de officieel goedgekeurde consensus blijven en zeker niet de eerste de beste blogger, immers voordat men het weet 'anyone can create a pseudo-environment that he thinks is wise or desirable.' En zoveel persvrijheid en vrijheid van meningsuiting kan de parlementaire democratie niet verdragen. "The public must be put in its place."

De invloedrijke Lippmann, een fervent adept van de imperialistische presidenten Theodore Roosevelt en Woodrow Wilson, was uiterst sceptisch over de mogelijkheid van een ware democratie in een complexe moderne samenleving. Het gewone volk kon zijn eigen belangen niet zomaar gaan formuleren, want dan zou het een chaos worden. Het publiek mocht tijdens verkiezingen zijn stem geven aan - door coöptatie gekozen – beleidsbepalers en verder niets. Om dit proces mogelijk te maken en zo glad mogelijk te laten verlopen, moest de pers worden gebruikt. Zij was verantwoordelijk voor het fabriceren van consensus… een zelfbewuste vaardigheid en standaard instrument van een regeringen die namens het volk besturen.’ Als lid van Wilson’s Commissie voor Publieke Informatie, speciaal in het leven geroepen om de oorlogspropaganda te coördineren, was Lippmann erin geslaagd de sentimenten zo te bespelen dat de aanvankelijke brede oppositie tegen Amerikaanse deelname aan de Eerste Wereldoorlog uiteindelijk als sneeuw voor de zon verdween.

Lippmann was een van de felste tegenstanders van de zogeheten muckrakers, Amerikaanse onderzoeksjournalisten die de corruptie van de grote concerns en hun zetbazen in de politiek telkens weer blootlegden. Lippmann: ‘The sense of conspiracy and secret scheming which trasnspire is almost uncanny. “Big Business,” and its ruthless tentacles, have become the material for feverish fantasy of illiterate thousands thrown out of kilter by the rack and strain of modern life. It is possible to work yourself into a state where the world seems a conspiracy and your daily going is beset with an alert and tingling sense of labyrinthine evil. Everything askew – all the frictions of life readily ascribed to a deliberate evil intelligence, and men like Morgan and Rockefeller take on attributes of omnipotence, that ten minutes of cold sanity would reduce to a barbarous myth.’

Het feit dat de rijkste 1 procent van de Amerikanen meer financiele rijkdom bezit dan de onderste 95 procent van de Amerikanen tesamen, moet als een 'barbarous myth' worden bestreden, de taak van de commerciele massamedia is namelijk 'het fabriceren van consensus… een zelfbewuste vaardigheid en standaard instrument', waarbij niet uit het oog moet worden verloren dat "Without some form of censorschip, propaganda in the strict sense of the word is impossible.'' En zo is het maar net. Vandaar dat de staat die allereerst de belangen van de 1 procent behartigt de commerciele massamedia zal moeten gaan subsidieren.
