Onlangs schreef de voormalige hoofdredacteur van de NRC Ben Knapen: 'Wall Street maakte vele jaren de dienst uit, betaalde praktisch voor elke senatorcampagne, was, kortom, het centrum van financiële, politieke en ideologische zwaartekracht.'

Knapen constateerde achteraf iets wat al vanaf tenminste het begin van de negentiende eeuw in brede kringen bekend is in de VS, namelijk dat het de politici er doorgaans corrupt zijn, gekocht kunnen worden door de hoogste bieder. Jarenlang is dat vooral ook de joodse pro-Israel lobby geweest. Ook dat is algemeen bekend in de VS.

Paul 2 emailde me dit: In a sign of growing concern in Prime Minister Binyamin Netanyahu's government over US President Barack Obama's Middle East policies, Minister-without-Portfolio Yossi Peled proposed Israeli sanctions on the US in a letter to cabinet ministers on Sunday.

In the 11-page letter, obtained by The Jerusalem Post from a minister on Monday, Peled recommends steps Israel can take to compensate for the shift in American policy, which he believes has become hostile to Israel.

But in the interim, the minister suggests reconsidering military and civilian purchases from the US, selling sensitive equipment that the Washington opposes distributing internationally, and allowing other countries that compete with the US to get involved with the peace process and be given a foothold for their military forces and intelligence agencies.

Peled said that shifting military acquisition to America's competition would make Israel less dependent on the US. For instance, he suggested buying planes from the France-based Airbus firm instead of the American Boeing.

In what may be his most controversial suggestion, Peled recommends intervening in American congressional races to weaken Obama and asking American Jewish donors not to contribute to Democratic congressional candidates. He predicted that this would result in Democratic candidates pressuring Obama to become more pro-Israel.

Het onvermijdelijke gebeurt nu: het gesloten front van de joodse Pro-Israel lobby in de VS begint scheurtjes te vertonen. 

'AIPAC Wall Beginning to Crack

For years, AIPAC (The American Israel Public Affairs Committee) has helped to stonewall the Middle East peace process by building a solid wall around the Israeli government, protecting it from criticism in the US. Senators and representatives have feared the wrath of AIPAC come Election Day, even in states and districts where the Jewish vote is negligible. Whatever they may have thought privately about Israel's policies toward the Palestinians, they've remained silent.

    I got a first-hand glimpse of the process shortly after last year's election, when I talked to an aide of a newly elected House member. The new member, who represents a district with hardly any organized Jewish community, knew very little about the Middle East when the campaign began. The representative had been "educated" on the issue, the aide told me, by a handful of wealthy Democrats - none from the member's district, all generous contributors to the campaign, and all staunch supporters of the AIPAC line. That's how it works, all over the country.

    Or at least that's how it used to work. Now, for the first time, there are signs of a crack in AIPAC's vaunted political edifice. The wedge issue is the Obama administration's public demand that Israel stop all new construction in its West Bank settlements, including what the Israelis call expansion to accommodate "natural growth."

    Though Israel's Prime Minister Benjamin Netanyahu heads the right-wing Likud party, settlement expansion is hardly a partisan matter in Israel. It has continued at a more or less unbroken pace for years, regardless of which party headed the government. And Israeli Defense Minister Ehud Barak, leader of the opposition Labor Party, is equally staunch in demanding the right of "natural growth."

    What's new is the serious objection being voiced in the US government, not merely by the president and his administration, but by members of Congress, including John Kerry, who heads the Senate Foreign Relations Committee, and several prominent Jewish lawmakers, such as Carl Levin, chair of the Senate Armed Services Committee; Howard Berman, chair of the House Foreign Relations Committee; and influential representatives Henry Waxman and Robert Wexler.


Al eerder sprak ik met Norman Finkelstein over de onvermijdelijke ontwikkeling waarbij de joodse lobby in de VS moet beslissen of ze blind achter 'de Joodse staat' blijft staan of de politiek van het eigen land zal gaan steunen. In mijn boek De oneindige Oorlog kunt u onder andere dit erover lezen:

Finkelstein: Voordat ik verderga wil ik eerst een kanttekening maken: er bestaat een vaak onuitgesproken veronderstelling dat er een of andere fundamentele tribale band bestaat die alle joden op aarde samenbindt, met als gevolg dat joden eerder voor Israël kiezen dan voor andere loyaliteiten. Ik vind dit een grote misvatting en dat wordt ook bewezen door de ontwikkelingen in de Verenigde Staten. Na de Tweede Wereldoorlog verdwenen tamelijk snel de belangrijkste barrières voor de joodse assimilatie en kregen de Amerikaanse joden alle mogelijkheden om deel te nemen aan de macht en privileges. Een voorbeeld daarvan is dat er in de jaren vijftig slechts een handjevol joodse hoogleraren aan de gerenommeerde universiteiten doceerde en dat dit nu radicaal anders is. Op hetzelfde moment dat hun kansen in de VS toenamen, werd Israël gesticht. Zoals gezegd hebben de joden altijd het stigma gedragen van de dubbele loyaliteit. Niet alleen zouden ze loyaal zijn aan het volk waarmee ze leven, maar ook aan het internationale jodendom. En ineens was er een staat die een concrete geïnstitutionaliseerde basis gaf aan de bewering van dubbele loyaliteit, want Israël claimt als “Joodse natie” namens alle joden ter wereld te spreken en eist de onvoorwaardelijke trouw van alle joden op. De eerste premier van het land, Ben-Goerion, wond daar geen doekjes om. In het begin van de jaren vijftig verklaarde hij tegenover Amerikaanse joden dat ze de staat Israël onder alle omstandigheden moesten steunen, of ze de betrokken regering zagen zitten of niet. De Amerikaanse joden waren volgens hem verplicht de belangen van Israël op de eerste plaats te zetten. Maar juist deze boodschap wilden ze niet horen, want hun mogelijkheden om vooruit te komen in de Verenigde Staten waren voor het eerst reëel geworden. En wat er dus gebeurde was niet verwonderlijk, de eerste generatie Amerikaanse joden na de Tweede Wereldoorlog bemoeide zich nagenoeg niet met Israël in de periode van de oprichting in 1948 tot de Juni Oorlog in 1967, behalve dan dat het land een object was van liefdadigheid. De bekendste joodse socioloog van zijn generatie, Nathan Glazer, concludeerde in 1957 in zijn boek American Jewry dat Israël, ik citeer, “opmerkelijk weinig uitwerking had op het innerlijke leven van Amerikaanse joden… Israël heeft nagenoeg niets betekend voor het Amerikaanse judaïsme… Het idee dat Israël… op een of andere serieuze manier het judaïsme in  Amerika kon beïnvloeden… wordt als denkbeeldig beschouwd.” In april 1967, vlak voor de Juni Oorlog, stelt een journalist van Haaretz de schrijver Elie Wiesel een vraag over Amerikaanse joden die zo massaal assimileren dat ze hun jood-zijn vergeten. Wiesel antwoordt dan dat de joodsheid van de joodse jeugd nog wel kan worden aangesproken, maar niet door middel van Israël. Misschien via de problemen van de joden in Rusland, misschien via vragen over de Holocaust, maar niet via Israël. Het werd als vanzelfsprekend beschouwd dat Amerikaanse joden niet nauw betrokken waren bij Israël. En dit gold in het bijzonder voor joodse intellectuelen in de VS. Tijdens meerdere symposia over de wijze waarop Amerikaanse joden hun joodse identiteit beleefden was kenmerkend dat Israël nauwelijks genoemd werd. Bijna geen van de joodse intellectuelen noemde Israël als element van zijn/haar joodse identiteit. U kent misschien Norman Podhoretz, de vroegere hoofdredacteur van Commentary, dat in 1945 door het American Jewish Committee werd opgericht. Norman is een voormalige linkse opiniemaker, die momenteel overtuigd neoconservatief is. 35 jaar lang werkte hij voor dit maandblad, dat gezien wordt als het belangrijkste joodse intellectuele tijdschrift in de VS. De loopbaan van Podhoretz is bijzonder illustratief voor de wijze waarop een groot deel van de Amerikaanse joden in de war raakte. Wanneer u zijn houding ten opzichte van Israël bestudeert dan ontdekt u dat in 1960, het eerste jaar van zijn hoofdredacteurschap, van de honderd hoofdartikelen in Commentary slechts twee artikelen over Israël gingen, 2 procent dus. Tijdens de laatste zes maanden voorafgaand aan de Juni Oorlog in 1967 werden er 57 hoofdartikelen gepubliceerd waarvan wederom slechts 2 iets te maken hadden met Israël of het zionisme. Pas veel later schreef Podhoretz, overigens terecht, dat Israël na 1967 “de religie van de Amerikaanse joden” was geworden. De hele veronderstelling van het bestaan van een eeuwige tribale loyaliteit is dan ook een absolute mythe. Die vermeende joodse onderlinge fundamentele trouw is niet gebaseerd op feiten. Een van de wonderlijke ironieën in deze geschiedenis is dat de enige twee echt joodse intellectuelen die vóór 1967 publiekelijk geïdentificeerd werden met Israël Noam Chomsky en Hannah Arendt waren. Beiden waren zionisten, professor Chomsky heeft zelfs in een kibboets geleefd, en de filosofe Arendt was geruime tijd een actieve linkse zioniste. Beiden zijn ook bekend vanwege hun fundamentele kritiek op “de Joodse staat”, en ze werden de belangrijkste zwarte schapen van de Israëllobby op het moment dat degenen die vroeger ongeïnteresseerd waren geweest, ineens veranderden in fanatieke verdedigers van het Israëlische expansionisme. De vraag is: vanwaar die ommezwaai? Wat was er gebeurd? De belangrijkste verandering was dat Israël een strategische aanwinst voor de Amerikanen was geworden. Het land voerde de Amerikaanse bevelen in het Midden-Oosten uit en daarom werkte de beschuldiging van de dubbele nationaliteit niet meer, loyaliteit aan Israël betekende loyaliteit aan de Verenigde Staten. Een dubbele loyaliteit betekende vanaf toen eigenlijk een superloyaliteit. Immers, Israël, dat in de frontlinies lag van het Midden-Oosten, verdedigde de Amerikaanse belangen tegen de horden van de Arabische wereld. En in tegenstelling tot de Amerikaanse militairen in Vietnam, wonnen de Israëlische strijdkrachten ook nog eens van de derdewereldbewoners. Er bestond geen conflict meer tussen het joods-zijn, pro-Israël zijn en pro-Amerika zijn, al die zaken waren nu keurig samengebundeld in één pakketje. Bovendien konden de Amerikaanse joden trots zijn op Israël. Niet alleen bleken ze goede krijgers te zijn, waardoor het beeld werd uitgewist dat joden zich alleen maar als makke schapen lieten afslachten, maar Israël leek ook nog eens een baken te zijn van de beschaving, democratie en liberale waarden die Amerikaanse joden zo waardeerden. Wat we nu zien, is dat die trotse houding aan haar eind is gekomen. De Israëlische politiek in de bezette gebieden en tegenover zijn buurlanden kan niet meer worden verenigd met liberale opvattingen.

It takes at least tacit faith in massive violence to believe that after three decades of horrendous violence in Afghanistan, upping the violence there will improve the situation. Despite the pronouncements from high Washington places that the problems of Afghanistan can't be solved by military means, 90 percent of the spending for Afghanistan in the Obama administration's current supplemental bill is military. Often it seems that lofty words about war hopes are boilerplate efforts to make us feel better about an endless warfare state. Oratory and punditry laud the Pentagon's fallen as noble victims of war, while enveloping its other victims in a haze of ambiguity or virtual nonexistence.

When last Sunday's edition of The Washington Post printed the routine headline, "Iraq War Deaths," the newspaper meant American deaths - to Washington's ultra-savvy, the deaths that really count. The only numbers and names under the headline were American.

Ask for whom the bell tolls. That's the implicit message - from top journalists and politicians alike.

A few weeks ago, some prominent US news stories did emerge about Pentagon air strikes that killed perhaps a hundred Afghan civilians. But much of the emphasis was that such deaths could undermine the US war effort. The most powerful media lenses do not correct the myopia when Uncle Sam's vision is impaired by solipsism and narcissism.

Words focus our attention. The official words and the media words - routinely, more or less the same words - are ostensibly about war, but they convey little about actual war at the same time that they boost it. Words are one thing, and war is another.

Yet words have potential to impede the wheels of war machinery. "And henceforth," Albert Camus wrote, "the only honorable course will be to stake everything on a formidable gamble: that words are more powerful than munitions."

A very different type of gamble is routinely underway at the centers of political power, where words are propaganda munitions. In Washington, the default preference is to gamble with the lives of other people, far away.

More than 40 years ago, Country Joe McDonald wrote a song, "An Untitled Protest," about war fighters: who "pound their feet into the sand of shores they've never seen / Delegates from the western land to join the death machine." Now, tens of thousands more of such delegates are on the way to Afghanistan.

In pseudo-savvy Washington, "appearance is reality." Killing and maiming, fueled by appropriations and silence, are rendered as abstractions.

The deaths of people unaligned with the Pentagon are the most abstract of all. No wonder The Washington Post is still printing headlines like "Iraq War Deaths." Why should Iraqis qualify for inclusion in Iraq war deaths?

There's plenty more media invisibility and erasure ahead for Afghan people as the Pentagon ramps up its war effort in their country.

War thrives on abstractions that pass for reality.

There are facts about war in news media and in presidential speeches. For that matter, there are plenty of facts in the local phone book. How much do they tell you about the most important human realities?

Millions of words and factual data pour out of the Pentagon every day. Human truth is another matter.

My father, Morris Solomon, recently had his ninetieth birthday. He would be the first to tell you that his brain has lost a lot of capacity. He doesn't recall nearly as many facts as he used to. But a couple of days ago, he told me: "I know what war is. It's stupid. It's ruining humanity."

That's not appearance. It's reality.

Het wordt voor de westerse commerciele massamedia steeds moeilijker om het joodse extremisme in Israel te negeren. De NRC bericht:

Twee staten? Fantasie, een sprookje, bromt Moshe Arens. „Het belangrijkste obstakel voor zo’n staat is de Palestijnse verdeeldheid. Komt u maar terug als die is opgelost.” Hij mag dan 83 zijn, Arens is nog altijd een uitgesproken deelnemer aan het Israëlische publieke debat. De oud-minister van Buitenlandse Zaken en Defensie schrijft alom gevreesde columns in de krant Ha’aretz, waar hij in januari fel oppositie voerde tegen het offensief tegen Hamas in de Gazastrook. Ondoordacht en onuitvoerbaar, vond hij.

Nu windt Arens zich op over de relatie tussen Israël en de Verenigde Staten. De in Boston geschoolde ingenieur vindt dat premier Benjamin Netanyahu niet mag zwichten voor Amerikaanse druk om met de Palestijnen te praten over een twee-statenoplossing. Het opgeven van de nederzettingenpolitiek in de bezette Westelijke Jordaanoever noemt Arens eveneens „onbespreekbaar”. Hooguit wil hij het hebben over de wilde buitenposten die ook volgens de Israëlische wet illegaal zijn.

De mening van de bedachtzaam pratende Arens doet ertoe in Israël. Hij geldt nog altijd als een belangrijke en invloedrijke spreekbuis van de rechtervleugel van de Likud-partij van Netanyahu. Arens gelooft in het joodse recht om nederzettingen te stichten in Judea en Samaria, zoals hij de Westelijke Jordaanoever noemt.

Netanyahu staat deze week voor een cruciaal moment in zijn tweede premierschap. Hij zal zondag zijn ideeën over vrede met de Palestijnen en de kwestie-Iran naar buiten brengen. Na de toespraak van de Amerikaanse president Obama staat Netanyahu voor een keuze. Hij kan Obama’s wens volgen en tegen eerdere uitspraken in beloven dat hij zal streven naar een onafhankelijke Palestijnse staat. Dan gaat hij de confrontatie aan met zijn rechtse coalitie. Of hij gaat de confrontatie met de VS aan en houdt vast aan zijn weigering mee te werken aan de stichting van een Palestijnse staat.

Is het verstandig dat Israël zich isoleert van de internationale gemeenschap, en de VS in het bijzonder?

„Ik denk niet dat de relatie tussen Israël en de VS wezenlijk is veranderd, laat staan beschadigd. We hebben sterke economische, historische en culturele banden. Maar er is wel een duidelijk verschil van inzicht aan het licht gekomen, dat al langer onder de oppervlakte zat. Obama gaf een geweldige toespraak, hij deed het goed. Ik weet alleen niet of hij zijn doel bereikt heeft.

De Nuance van de NRC 110

Afgelopen vrijdag luidde het commentaar van de NRC alsvolgt:

 De voorlopige uitslag van de verkiezingen in Nederland voor het Europees Parlement weerspiegelt de grote verdeeldheid onder de bevolking over Europa. Het meest opmerkelijke is de grote winst die de PVV gisteren boekte en bijna even opvallend is het gigantische verlies dat de PvdA moest incasseren. Heeft de kiezer nu duidelijkheid geschapen? Nee. De resultaten van gisteren tonen eens te meer aan dat de kiezer die altijd gelijk heeft, niet bestaat. Tegenover de overwinning van de jegens Europa vijandige PVV staat de winst van vooral D66 en ook GroenLinks, de partijen die zich het meest pro Europa hebben getoond… De kiezers zijn dus verdeeld over de rol die de Europese Unie moet spelen, althans: voor zover het ze interesseert. Want het meest teleurstellende aan de uitslag is de opkomst, die weer laag was, lager nog dan vijf jaar geleden. De 25 Nederlandse europarlementariërs vertegenwoordigen de komende jaren in Brussel en Straatsburg opnieuw slechts een minderheid van de bevolking.… De diepste wonden werden geslagen bij de PvdA. Die partij zakte bijvoorbeeld in Amsterdam naar de derde plaats en is ook in Rotterdam en Utrecht niet meer de grootste.

 Dit commentaar is warrig en de oorzaak van die verwarring is het feit dat de commentator iets probeert te verzwijgen dan wel iets niet begrijpt.

 Allereerst dit: volgens het commentaar ‘weerspiegelt de grote verdeeldheid onder de bevolking over Europa.’ Dat is een onjuiste bewering zoals vervolgens ook blijkt uit het commentaar zelf: ‘De kiezers zijn dus verdeeld over de rol die de Europese Unie moet spelen, althans: voor zover het ze interesseert. Want het meest teleurstellende aan de uitslag is de opkomst, die weer laag was, lager nog dan vijf jaar geleden.’ Met andere woorden: slechts 36,5 procent heeft gestemd, ongeveer eenderde van de kiesgerechtigden, en dus kan men niet spreken van ‘de grote verdeeldheid onder de bevolking over Europa.’ We weten niet hoe massaal de verdeeldheid is zolang de overgrote meerderheid niet stemt. En dat beseft de commentator ook onmiddellijk in de volgende zin: ‘De 25 Nederlandse europarlementariërs vertegenwoordigen de komende jaren in Brussel en Straatsburg opnieuw slechts een minderheid van de bevolking.’  Vooral deze zin is kernmerkend voor de verwarring bij de commentator: ‘Het meest opmerkelijke is de grote winst die de PVV gisteren boekte en bijna even opvallend is het gigantische verlies dat de PvdA moest incasseren.’

 Waarom is voor deze politiek commentator van de slijpsteen voor de geest ‘het gigantische verlies’ van de PVDA ‘opvallend’ en ‘het meest opmerkelijke de grote winst die de PVV boekte’?

 Kennelijk beseft deze commentator niet dat er al op in het afgelopen decennium een omslag heeft plaatsgevonden.

 Beste collega, laat ik je proberen uit te leggen wat er gaande is. President Lincoln zei het aldus: ‘It is true that you can fool all of the people some of the time; you can even fool some of the people all of the time; but you can not fool all of the people all of the time.’ En zo is dat. Een voorbeeld uit de praktijk. Je kunt niet op een vrijdagmiddag zonder de volksvertegenwoordiging te hebben geraadpleegd als sociaaldemocratische minister van Financien besluiten om bankiers miljarden euro’s aan belastinggeld te geven om hun failliete handel overeind te houden om vervolgens tegen de bevolking te zeggen dat hun pensioengerechtigde leeftijd met twee jaar omhoog moet en hun pensioengelden omlaag omdat, let op, er geen geld meer is om het te betalen. 

Beste NRC-commentator, uit bijna een halve eeuw ervaring weet ik dat er van journalisten van commerciele massamedia verwacht wordt dat ze de officiele versie van de werkelijkheid geven. Of, zoals de VPRO-journalist Chris Kyne destijds verklaarde: 'had u tot voor kort gedacht dat een minister van Financien er mee weg zou komen wanneer hij tegen de Kamer zei: "Nee, natuurlijk heb ik u vorige week, toen ik op het punt stond de grootste ingreep in de economie te doen die een minister van financien ooit heeft gedaan, niet de waarheid verteld. En als ik volgende week een nog grotere ingreep ga doen, vertel ik het u weer niet.'' Is toch gebeurd. Gaat over democratie. En het vreemdste is: we vinden allemaal nog dat Bos gelijk heeft ook. Voor ons journalisten was het natuurlijk niet nieuw dat Wouter Bos ons niet altijd de waarheid vertelde. Wel is het nieuw dat ik op dit moment even niet meer weet of ik wel even hard als vroeger mijn best moet doen om hem die waarheid te laten vertellen. Of er inderdaad niet even een hoger belang is dan "de waarheid, niets dan de waarheid."'

 En zo collaboreert onze vakgroep, de journalistiek, elke dag weer met de macht. Vandaar ook dat bij het grote publiek de journalistiek niet in hoge achting staat. Nu komen we bij het punt dat u, NRC commentator, kennelijk niet begrijpt. Hoewel de -- wat Hofland noemt -- ‘politiek literaire elite’ van de polder de propaganda nagenoeg ongeclausuleerd verspreidt, is er tegelijkertijd een groeiend aantal burgers dat dwars door de propaganda heen kijkt. Sterker nog, steeds meer burgers worden razend van woede; de tekening van Collignon vandaag in de Volkskrant geeft dit goed weer.  En waarom worden ze razend? Welnu, mensen wensen serieus te worden genomen, anders gesteld: autoriteiten in een parlementaire democratie moeten ervoor zorgen dat niet telkens weer de waardigheid, het zelfrespect, van kiezers geschonden worden. Ze willen bijvoorbeeld niet dat in het parlement voortdurend een toneelstukje wordt opgevoerd, dat er een schijnvoorstelling plaatsvindt, omdat de besluiten al voorgekookt zijn in achterkamertjes. Het is vernederend om almaar te worden geconfronteerd met het feit dat jij als burger niet echt meetelt, dat je er voor spek en bonen bijzit, dat een kleine groep zich verrijkt ten koste van de meerderheid. En dit alles nog eens normaal dient te vinden. Mensen zijn uiteindelijk niet zo onwetend om niet te beseffen dat bijvoorbeeld de sociaaldemocraten en de socialisten het spelletje meespelen en geen alternatief hebben voor het neoliberalisme en daardoor meedoen aan het nepotisme en de vriendjespolitiek van de elite. Kijk eens naar de televisie waar dag in dag uit dezelfde hoofden in wisselend gezelschap elkaar de bal toespelen. Een groeiend aantal burgers, vooral aan de onderkant van de samenleving, die de prijs betaald voor het kapitalisme, roert zich nu. En dat verbaast de ‘politiek literaire elite’ van Hofland. Die verbazing komt voort uit het feit dat deze elite de greep op de werkelijkheid heeft verloren en in haar zelf geschapen werkelijkheid is gaan geloven. Deze zienswijze, beste NRC commentator, zal nooit door uw krant, dat de slijpsteen voor de geest zegt te zijn, gepubliceerd worden, aangezien het in strijd is met de dagelijkse propaganda. De bestaande werkelijkheid gaat net zolang mee tot de wal het schip keert.

SA academic study finds that Israel is practicing apartheid and colonialism in the Occupied Palestinian Territories The Human Sciences Research Council of South Africa (HSRC) has released a study indicating that Israel is practicing both colonialism and apartheid in the Occupied Palestinian Territories (OPT). The study is being posted for public debate on this website. The interim report, which will form part of a discussion at an upcoming HSRC conference on the subject, titled Re-envisioning Israel/Palestine, on 13 and 14 June in Cape Town, serves as a document to be finalised later this year.

The HSRC commissioned an international team of scholars and practitioners of international public law from South Africa, the United Kingdom, Israel and the West Bank to conduct the study. The resulting 300-page draft, titled Occupation, Colonialism, Apartheid?: A re-assessment of Israel's practices in the occupied Palestinian territories under international law, represents 15 months of research and constitutes an exhaustive review of Israel's practices in the OPT according to definitions of colonialism and apartheid provided by international law. The project was suggested originally by the January 2007 report by eminent South African jurist John Dugard, in his capacity as Special Rapporteur to the United Nations Human Rights Council, when he indicated that Israel practices had assumed characteristics of colonialism and apartheid.

Regarding colonialism, the team found that Israel's policy and practices violate the prohibition on colonialism which the international community developed in the 1960s in response to the great decolonisation struggles in Africa and Asia. Israel's policy is demonstrably to fragment the West Bank and annex part of it permanently to Israel, which is the hallmark of colonialism. Israel has appropriated land and water in the OPT, merged the Palestinian economy with Israel's economy, and imposed a system of domination over Palestinians to ensure their subjugation to these measures. Through these measures, Israel has denied the indigenous population the right to self-determination and indicated clear intention to assume sovereignty over portions of its land and natural resources. Permanent annexation of territory in this fashion is the hallmark of colonialism.

Regarding apartheid, the team found that Israel's laws and policies in the OPT fit the definition of apartheid in the International Convention on the Suppression and Punishment of the Crime of Apartheid. Israeli law conveys privileges to Jewish settlers and disadvantages Palestinians in the same territory on the basis of their respective identities, which function in this case as racialised identities in the sense provided by international law. Israel's practices are corollary to five of the six 'inhuman acts' listed by the Convention. A policy of apartheid is especially indicated by Israel's demarcation of geographic ‘reserves' in the West Bank, to which Palestinian residence is confined and which Palestinians cannot leave without a permit. The system is very similar to the policy of ‘Grand Apartheid' in apartheid South Africa, in which black South Africans were confined to black homelands delineated by the South African government, while white South Africans enjoyed freedom of movement and full civil rights in the rest of the country.

The Executive Summary of the report says that the three pillars of apartheid in South Africa are all practiced by Israel in the OPT. In South Africa, the first pillar was to demarcate the population of South Africa into racial groups, and to accord superior rights, privileges and services to the white racial group. The second pillar was to segregate the population into different geographic areas, which were allocated by law to different racial groups, and restrict passage by members of any group into the area allocated to other groups. And the third pillar was "a matrix of draconian ‘security' laws and policies that were employed to suppress any opposition to the regime and to reinforce the system of racial domination, by providing for administrative detention, torture, censorship, banning, and assassination."

The Report finds that Israeli practices in the OPT exhibit the same three 'pillars' of apartheid:

The first pillar "derives from Israeli laws and policies that establish Jewish identity for purposes of law and afford a preferential legal status and material benefits to Jews over non-Jews".

The second pillar is reflected in "Israel's 'grand' policy to fragment the OPT [and] ensure that Palestinians remain confined to the reserves designated for them while Israeli Jews are prohibited from entering those reserves but enjoy freedom of movement throughout the rest of the Palestinian territory. This policy is evidenced by Israel's extensive appropriation of Palestinian land, which continues to shrink the territorial space available to Palestinians; the hermetic closure and isolation of the Gaza Strip from the rest of the OPT; the deliberate severing of East Jerusalem from the rest of the West Bank; and the appropriation and construction policies serving to carve up the West Bank into an intricate and well-serviced network of connected settlements for Jewish-Israelis and an archipelago of besieged and non-contiguous enclaves for Palestinians".

The third pillar is "Israel's invocation of 'security' to validate sweeping restrictions on Palestinian freedom of opinion, expression, assembly, association and movement [to] mask a true underlying intent to suppress dissent to its system of domination and thereby maintain control over Palestinians as a group."

The research team included scholars and international lawyers based at the HSRC, the School for Oriental and African Studies (London), the British Institute for International and Comparative Law, the University of Kwa-Zulu Natal (Durban), the Adalah/Legal Centre for Arab Minority Rights in Israel and al-Haq/West Bank Affiliate of the International Commission of Jurists. Consultation on the study's theory and method was provided by eminent jurists from South Africa, Israel and Europe.

‘Loyalty oath’ to keep Arabs out of Galilee town

MISGAV, ISRAEL // A community in northern Israel has changed its bylaws to demand that new residents pledge support for “Zionism, Jewish heritage and settlement of the land” in a thinly veiled attempt to block Arab applicants from gaining admission.

Critics are calling the bylaw, adopted by Manof, home to 170 Jewish families in Galilee, a local “loyalty oath” similar to a national scheme recently proposed by the far-Right party of the government minister Avigdor Lieberman.

Other Jewish communities in the central Galilee – falling under the umbrella of a regional council known as Misgav – are preparing similar bylaws in response to a court petition filed by an Arab couple hoping to build a home in Misgav.


“It looks very much like this is being co-ordinated by the Misgav council in an attempt to pre-empt the court ruling,” said Ronin Ben Ari, resident of another Misgav community, Mikhmanim, and an opponent of the bylaw change.

Manof’s move comes in the wake of efforts by Ahmed and Fatina Zbeidat, who live in the neighbouring Arab town of Sakhnin, to win admission to the Misgav community of Rakafet.

Traditionally some 700 rural communities in Israel, including 30 in Misgav, have weeded out Arab applicants by issuing automatic rejections through special vetting committees. Arab citizens make up one-fifth of the country’s population.

According to a legal rights group, rural communities, which are home to only five per cent of the population but have control over four-fifths of the countryside, are seen by the state as a bulwark against Arabs gaining access to what are called “national lands”.

However, the vetting system has been under threat since a court ruling in 2000 that required the committees to consider Arab applicants and justify their decisions.

In line with the ruling, the Zbeidats demanded the right to take a suitability test when their application was turned down in 2006. Examiners found Fatina too “individualistic” for life in a small community while her husband lacked “knowledge of sophisticated interpersonal relations”.

The Zbeidats then petitioned the courts against the use of vetting committees, saying they enforced “blatant discrimination” against Arab applicants.

Earlier this year, in an indication that the court was preparing to back them, it demanded that the attorney-general explain why the vetting committees should continue.

“There is little doubt that many residents of Misgav are panicking about the court case,” said Mr Ben Ari, who heads a small dissident group called Alternative Voice in the Galilee.

He added that Ron Shani, who was elected Misgav’s mayor late last year, made opposition to the Zbeidats’ bid to live in Rakafet a major platform in his campaign.

Mr Shani defended the bylaw change last week to the Israeli media. “The council’s position is that it is appropriate to strengthen the character of the community – a community in which Zionist values and Jewish heritage stand at the heart of its way of life. We don’t see this as racism in any way.”

Mr Ben Ari said: “There is a widely held feeling in Misgav that changing the bylaws is a legitimate way for the Jewish minority in the Galilee to defend itself against an Arab and Islamic danger.

“The residents here are not right-wing types like Lieberman. They see themselves as liberals and in fact are made very uncomfortable by the Lieberman comparison.”

A bill proposed by Mr Lieberman’s Yisrael Beiteinu party that conditioned citizenship on declaring loyalty to a Jewish state was rejected by a ministerial committee last week.

The bylaw, accepted by an overwhelming majority in Manof, stipulates that applicants must share “the values of the Zionist movement, Jewish heritage, settlement of the Land of Israel ... and observance of Jewish holidays”.

It also proposes that local children be encouraged to join the Zionist youth movement and the Israeli army.

A similarly worded proposal will come before another Misgav community, Yuvalim, later this month.

One resident opposed to the change, Arik Kirschenbaum, told the liberal Haaretz newspaper last week: “It suddenly seems as if we adopted bylaws from the settlements.”

Residents of Manof have been quoted in the Israeli media decrying accusations of racism.

“It’s unpleasant and even offensive to wake up one morning and find that you’ve turned into Lieberman,” said Alon Mayer, pointing out that Yisrael Beiteinu won only 2.5 per cent of Manof’s vote in the February general election.

Several residents were reported to fear that living alongside Arabs might lead to ethnic tensions and sectarian violence.

Suhad Bishara, a lawyer with the Adalah legal rights group who is representing the Zbeidats, said: “There is nothing unique or special about the way of life in these communities to justify this kind of restriction on admission.

“Rather, the purpose of the selection system is to make sure 80 per cent of the territory inside Israel is not accessible to Arabs, that the control of public resources stays exclusively in Jewish hands.”

The Zbeidats’ application was submitted after they were unable to find a building plot in Sakhnin. The town’s young couples face increasing difficulties building homes after much of Sakhnin’s land was turned over to Misgav’s jurisdiction.

Sakhnin officials point out that its 25,000 inhabitants have only one-twentieth of the land available to the 20,000 residents of Misgav’s 30 communities. An appeal by Sakhnin that it be awarded some of Misgav’s land was rejected by a boundary commission in 2005.

Misgav promotes itself, in the words of its website, as a model of “ethnic pluralism” because it includes 5,000 Bedouin.

However, critics note that Misgav’s Bedouin live in a handful of separate communities deprived of the land available to the Jewish communities.

The Bedouin inhabitants are generally denied basic services such as water and electricity, as well as schools and medical clinics. In one, Arab al Naim, the inhabitants are forced to live in tin shacks because permanent structures are demolished by the state.

Last week, three members of the Israeli parliament introduced a bill stipulating that vetting committees should assess candidates’ “suitability to the community’s way of life and social fabric”. The legislators said the bill would help in “maintaining the Zionist vision”.
