De Nuance van de NRC 160

In welke mate de NRC -redactie niet meer in staat is de werkelijkheid te zien blijkt wel uit de reactie van de chef van NRC Weekblad, Gijsbert van Es, aan de voorzitter van Een Ander Joods Geluid:

Geachte heer Hamburger,

Het spijt mij dat u zich heeft gestoord aan de fotoreportage over de vrouwelijke Israëlische soldaten in NRC Weekblad van 2 januari jl. De redactie van NRC Weekblad heeft de foto's niet gepubliceerd om geweld in het algemeen en van het Israëlische leger in het bijzonder te romantiseren. Wij menen dat onze lezers de rol van Israël en z'n leger in dit conflict kennen en er een eigen oordeel bij kunnen vormen. Ikzelf heb de foto's niet gezien als romantisering maar als een scherp "statement", als een illustratie voor het absurde contrast tussen enerzijds deze foto's en anderzijds het gebruik van geweld. U heeft gelijk dat het tijdstip van publicatie niet gelukkig is gekozen.

Met andere woorden: dat wat talloze NRC-lezers wel zagen, de romantisering van het geweld, kon chef Van Es niet zien. Het onderstreept andermaal dat de propagandarol die de krant speelt niet door de betreffende journalisten wordt beseft, maar wel door het publiek.

Een van de manieren waarop je de uitkomst van het rapport van de Commissie Davids mede zal kunnen verklaren, is door de achtergronden te onderzoeken van de betrokken commissieleden. Ik heb dit gedaan met het commissielid Peter van Walsum, een gehoorzame diplomaat die niet van 1 maar van 2 NRC-journalisten de volgende kwalificaties kreeg: 'het beste dat Nederland in huis heeft,' een topdiplomaat die 'zijn naam als eigenzinnig denker met scherpe tong waar[maakte].' En: als 'voorzitter van de wereld' is hij 'twee jaar lang het visitekaartje in het buitenland geweest.'

Deze diplomaat die als 'het beste' werd gepresenteerd 'het visitekaartje' van Nederland, bleek ineens een heel andere autoriteit te zijn toen hij door een echte journalist werd geinterviewd over zijn rol als voorzitter van het Irak sanctiecomite, mede verantwoordelijk voor sancties die volgens de betrokken VN mensen zelf 'genocidaal' waren

Kunnen we veel van dit gecorrumpeerde commissielid verwachten wat betreft waarheidsvinding? Nee, lijkt me, Van Walsum zelf heeft tonnen boter op zijn hoofd. Daarover heeft de NRC met geen woord gerept. Integendeel, de topdiplomaat werd door maar liefst twee NRC-journalisten bejubeld. Welnu Mark, aan de slag, zoek uit, wie precies de commissieleden zijn, wat hun achtergrond is, en welke belangen ze vertegenwoordigen. En dan hoef jij niet meer te concluderen: 'En dan? Dan horen we het cliche: gaan er nog koppen rollen.'

Licht je lezers in, daar word je voor betaald.

Ignore the jailers' talk. There are of course bad jailers and less bad. In certain conditions it's useful to note the difference. But what they say -- including the less evil ones -- is bullshit. Their hymns, their shibboleths, their incanted words, security, democracy, identity, civilization, flexibility, productivity, human rights, integration, terrorism, freedom are repeated in order to confuse, divide, distract and sedate all fellow prisoners. On this side of the walls, words spoken by the jailers are meaningless and are no longer useful for thought. They cut through nothing. Reject them even when thinking silently to oneself.

Mark Kranenburg, zonder dat jij en de jouwen het door hebben, is er een nieuwe werkelijkheid ontstaan, die volledig losstaat van de door jou en de jouwen eindeloos gepropageerde 'werkelijkheid.' De pers heeft het monopolie op de waarheidsbepaling verloren, net zoals de katholieke kerk die verloor toen de drukpers werd uitgevonden. Jouw taal is gecorrumpeerd geraakt en het probleem voor de autoriteiten is dat de burger dit maar al te goed is gaan beseffen. Jouw taal is inhoudsloos geworden, je boodschap betekenisloos, en ondertussen -- meanwhile -- ben je doof en blind voor al het andere. Je bent in een absurdistisch toneelstuk beland waarbij je nog wel een rol speelt, maar niet doorhebt dat het publiek al lang beseft dat het slechts een rol is en niet meer dan dat, terwijl jij je dat niet realiseert. Luister naar de dissidenten, de kunstenaars, de schrijvers.

Israel must stop boycotting International Criminal Court

Former Supreme Court president Aharon Barak has recommended that
Israel join the International Criminal Court at The Hague that tries
those indicted for war crimes and crimes against humanity. Barak, who
spoke on Monday at a legal conference in Jerusalem, says that Israel
will benefit from its participation in the court despite the risk
that IDF soldiers and officers, and even Israeli politicians, may be
brought to trial.

Israel was one of the countries behind the ICC initiative, but
changed its stance at the last minute, once settlements in the
territories were included in the list of serious crimes under the
court's jurisdiction. At the end of 2000, following an intense debate
in the government, Israel signed the Rome Statute from which the
International Criminal Court was established, but said it would not
ratify its signature because of concerns that the institution would
be used for political ends. Since then, Israel has stuck by its
refusal to join the ICC and be answerable to its judgments.

Barak said that "Israel is part of the international community, and
it must conduct itself in accordance with the interpretation that is
common in international law." As president of the Supreme Court,
Barak changed an entrenched approach that rejected court involvement
in security considerations. In a ruling on the issue of the route of
the separation fence, he established the formula of "reason and
proportionality" in the exercise of security authority in the
territories. His approach also guided the current court president,
Justice Dorit Beinisch, in last week's ruling regarding the use of
Route 443 by Palestinians.

Since the ICC began its work at The Hague, international law has
received increased attention in Israel. Operation Cast Lead in the
Gaza Strip a year ago raised serious allegations against Israel for
violating the rules of war and even carrying out crimes against
humanity. Israel responded that the IDF is "the most moral army in
the world," and that international law must take into consideration
the exigencies of the war against terrorism, but refused to cooperate
with the Goldstone Commission and denounced its report.

A country that believes in the morality of its actions and those of
its soldiers should not behave like a permanent suspect and boycott
institutions of international law. On the contrary: It must fight
within those institutions for its positions and justice. Joining the
International Criminal Court at The Hague will place Israel on the
side of the enlightened nations, and will contribute to restraining
forceful and harmful actions. Barak's recommendation deserves to be
adopted.

Dit zal volgens Mark Kranenburg, politiek redacteur van de NRC, het enige resultaat zijn als de Commissie Davids tot de slotsom komt dat premier Balkenende in strijd met het internationaal recht heeft gehandeld door troepen naar Irak te sturen.

De vraag of er 'koppen rollen,' is volgens Kranenburg een cliche. Waarom? Moeten er dan geen politieke consequenties volgen wanneer democratisch gekozen volksvertegenwoordigers misdaden begaan? Kennelijk niet. Maar waarom niet, collega Kranenburg?

Ik kocht eergisteren in een leuke boekenzaak in Parijs, de Village Voice Bookshop, http://www.villagevoicebookshop.com/ het prachtige essay Meanwhile van John Berger, waarin hij het volgende stelt:

I'm searching for words to describe the period of history we're living through. I'm not searching for a complex definition -- I'm looking for nothing more than a figurative image to serve as a landmark. The landmark I've found is that of a prison. Nothing less. Across the planet we are living in a prison.'

En de bewakers van die gevangenis zijn ondermeer de mensen die zin en betekenis geven aan woorden en begrippen, de opiniemakers zoals jij, Mark Kranenburg, de woordvoerders van de macht, die geen tegenmacht duldt.

Berger: Look at the power structure of the surrounding world, and how its authority functions. Every tyranny finds and improvises its own set of controls. Which is why they are often, at first, not recognized as the vicious controls they are. The market forces dominating the world asseert that they are inevitably stronger than any nation-state. The assertion is corroborated every minute.

In de Financial Times van dit weekeinde staat op de voorpagina: 'Bankers in the City of London will suffer little or no impact from the bonus supertax imposed by the British government last month.'

Daarom Mark Kranburg, je cynisme waarbij je overal de prijs van weet en van niets de waarde, is misplaatst. 'En dan? Dan horen we het cliche: gaan er nog koppen rollen.' De macht is de macht omdat journalisten als jij geen tegenmacht vormen. En weet je wat totalitair is? Welnu, het feit dat je niet aan te spreken bent hierop, het feit dat je alleen met je eigen kleine kring discussieert, dat je zwijgt wanneer er een dissidente zienswijze wordt geponeerd,

en dat je weigert in te gaan op dat wat er in de samenleving speelt, het feit dat de macht altijd autistisch is, totdat zich een tegenmacht aandient.

Mark Kranenburg. IJdelheid en Cliche's.

Mark Kranenburg is politiek redacteur van de NRC. In NRC-weekblad meldt hij dat Willibrord Davids, 'de man-van-de-week' wordt, en wel omdat hij voorzitter is van de Commissie-Davids dat onder politieke druk in het leven werd geroepen om te onderzoeken 'hoe en waarom Nederland in 2002 en 2003 steun gaf aan de oorlog in Irak.' Aanstaande dinsdag worden de bevindingen gepubliceerd. Al bij de omschrijving van de Commissie gaat Kranenburg in de fout, en wel omdat 'de oorlog' geen oorlog was in de klassieke betekenis van het woord, maar een razendsnelle militaire inval in een economisch en militair totaal verzwakt land. Bovendien was het 'geen oorlog' maar een illegale gewelddadige inval in strijd met het internationaal recht, zoals nog eens werd benadrukt door de toenmalige VN secretaris-generaal Kofi Annan toen hij tegenover de BBC verklaarde dat 'the US-led invasion of Iraq an illegal act [was] that contravened the UN charter.'

Dat is een slecht begin voor een politiek redacteur van de slijpsteen voor de geest, want het betreft hier geen kleine verschrijving, misvatting, maar een ernstige en wezenlijke fout, zoals blijkt uit het 'ambtelijke stuk van Buitenlandse Zaken uit 2003, waarin juristen zeiden: politieke steun aan de oorlog in Irak, dubieus!' Dat schrijft Kranenburg zelf, met andere woorden: dan is er dus geen rechtsgrond voor de illegale inval en is Nederland betrokken geweest bij een ernstige schending van het internationaal recht. Het plannen van een agressie-oorlog was een van de redenen waarom de aangeklaagde nazi-kopstukken in Neurenberg tot de doodstraf werden veroordeeld. Het gaat dus niet om niets.

Met dit als achtergrond is het interessant te lezen wat Kranenburg verder schrijft. Dit: 'Wat zal het onderzoek opleveren?' Als Balkenende gelijk heeft: geen letter nieuws. Maar de ervaring leert dat er bij gewroet altijd wel wat naar boven komt: elkaar tegenwerkende overheidsdiensten bijvoorbeeld, of een onjuist geinformeerde Kamer.'

Wat staat hier nu precies? Welnu, Kranenburg, die zelf als politiek redacteur van de 'kwaliteitskrant' geen eigen serieus onderzoek heeft verricht naar hoe de macht heeft gehandeld, negeert meteen het feit dat Balkenende nooit gelijk kan hebben om de simpele reden dat de inval illegaal was, in strijd met het internationaal recht en het VN-handvest zoals Kofi Annan -- kennelijk tevergeefs -- nog eens verklaarde. Het internationaal recht telt alleen niet voor de Kranenburgen van de Nederlandse journalistiek. Hij eindigt met 'En dan? Dan horen we het cliche: gaan er nog koppen rollen.'

Beste collega Kranenburg, weet je waarom het eindigt met een cliche? Welnu, dat komt omdat journalisten zoals jij je werk niet doen. Geen onderzoek verrichten, geen follow-ups geven, etc. Jij en de andere Nederlandse politiek redacteuren zijn te lui om serieus onderzoek te verrichten. Jullie zijn te dicht tegen de macht aangekropen en daarmee intellectueel corrupt geraakt. Het probleem van de democratie is niet het feit dat die door politici wordt misbruikt, want dat is onvermijdelijk, het ware probleem van de democratie is dat er geen tegenmacht meer is die de macht controleert. Mark Kranenburg: ga je werk doen, in plaats van gelegenheidsstukjes in het NRC weekblad te schrijven. En lees eerst dit even: achtergronden zoals ik die ontdekte nog voordat Irak was binnengevallen.

Goldstone clause could lead to sanctions

The Goldstone Report included a threat to Israel that had been
overlooked so far but could lead to voluntary, far-reaching economic
sanctions against Israel by UN members, a US Jewish organization, the
American Jewish International Relations Institute (AJIRI), warned on
Wednesday.

According to former US ambassador Richard Schifter, the threat comes
from a paragraph in the report's recommendations referring to a UN
provision stating that if the Security Council does not order action
to be taken by the UN against Israel, members of the General Assembly
may take voluntary, collective action instead.

The provision was used by the General Assembly members to apply tough
economic sanctions against South Africa in 1982 and AJIRI is
concerned that it could now be used against Israel.

The Goldstone Commission recommended that the General Assembly may
remain apprised of the implementation of its findings and
recommendations "until it is satisfied that appropriate action is
taken at the domestic and international level to ensure justice for
victims and accountability for perpetrators."

The General Assembly may consider whether additional action within
its powers is required in the interests of justice, including under
Resolution 377 (V) "Uniting for Peace."

According to the "Uniting for Peace" resolution, if the Security
Council fails to take action due to a lack of unanimity among its
permanent members - apparently a reference to a veto by one or more
of the five permanent members - "the General Assembly shall consider
the matter immediately with a view to making appropriate
recommendations to members for collective measures, including, in the
case of breach of the peace or an act of aggression, the use of armed
force when necessary to maintain or restore international peace and
security."

Schifter said the resolution was first drafted and used to sanction
UN countries to wage war against North Korea in 1950 and to impose
economic sanctions against the apartheid South African regime in
1982. It was originally spearheaded by the US after the Soviet Union
vetoed Security Council resolutions ordering the UN to take measures
against North Korea.

Schifter told The Jerusalem Post his suspicions regarding the intent
of this recommendation in the Goldstone Report were triggered by the
fact that many equate the apartheid regime in South Africa with
Israel.
"I think the people who wrote this recommendation had in mind the
action taken in 1982," he told the Post.

Only the UN Security Council can order member nations to take action.
Schifter estimated that of the 15 countries currently on the Security
Council, only eight would vote in favor of a motion to refer the
Goldstone Report to the International Criminal Court. His estimate
was based on these countries' votes on a General Assembly resolution
on November 5, 2009, which endorsed the report. Six other current
members of the Security Council abstained in that vote, while the US
voted against. The General Assembly vote was 114 in favor of
endorsing the report, 18 against, 46 abstentions and 16 absences.

A majority of at least two-thirds of the Security Council members is
required to approve a resolution. Currently, those in favor of
referring the report to the ICC are one short of the necessary
majority. Even if they obtain it, however, any one of the permanent
Security Council members may cast a veto. Schifter predicted that the
US would do so if necessary. Thus he believes that the threat of an
ICC investigation is negligible.

But that does not mean Israel is out of danger of economic sanctions
by UN members acting collectively because of the Uniting for Peace
resolution. He advised Israel to campaign inthe General Assembly to
secure a blocking vote of one-third plus one of the countries that
cast their ballots, or to prevent the supporters of the resolution
from obtaining more than 50 percent of the votes of all UN member
states.

Meanwhile, an official said the government was aware of the Goldstone
Report's Uniting for Peace resolution, but was more concerned with
preventing the report from reaching the ICC, which, he said, was "a
more serious" matter.
