The Legal Saga of Abu Nakba

The judge: We will begin to hear the case of The State of Israel v. Abed Aghbariya. How does the defendant plead?

 The defense attorney: The defendant pleads not guilty, your honor.

 The prosecutor asks to call a policeman as its main and only witness to the witness stand.

 The policeman: The procession that took place on Independence Day in Umm al-Fahem was organized to mark what the minorities call “Nakba Day.” The defendant marched in the procession and chanted slogans denouncing the State of Israel and occasionally mentioning the word “Nakba.”

 The prosecutor: How many times, if you recall, did the defendant use the word “Nakba?”

 The policeman: More than ten times, and in various rhymes.

 The prosecution rests its case. The defense attorney announces that he is not interested in questioning the policeman. The prosecutor declares that the prosecution has proven all of the facts relevant for conviction under the new Nakba Law. The Nakba Law prohibits conducting any activity that “marks Independence Day, or refers to the establishment of the State of Israel, as a day of mourning or as a day of sorrow.” The court session is adjourned.

 

There is an even larger presence of local and international journalists at the second hearing on the case than at the first. Everyone is interested today in the great question that occupies the experts: What would be Abed’s line of defense? Would his defense attorney carry out the promise of the Union of Arab Lawyers in Israel and call witnesses to testify about the Nakba and the Palestinian historic injustice in order to justify the participation of Arabs in Nakba Day processions? The judge enters the courtroom and everyone rises in his honor. The defense attorney asks to call as a witness Abu Ali, a man of high esteem, 82 years old, from Umm al-Fahem. Abu Ali seems happy to have reached this occasion. He seems healthy, and physically steady. He testifies in Arabic, with simultaneous translation.

 

The defense attorney: Mr. Abu Ali, please tell the honorable court, what is your expertise?

 

Abu Ali: I am an expert in the affairs of bayt ajar – a house of mourning – and I am known as the greatest expert in this field in the Aghbariya neighborhood. For twenty years, I have participated in every bayt ajar in the neighborhood and no one has passed away without my participation in the prayers for him.

 

The defense attorney: Please explain to the court how it is customary and accepted to act in a bayt ajar?

Abu Ali: We read verses from the Qur’an and, throughout the day, we occasionally pray to God to have mercy on the deceased, to bring him into Paradise and include him on the list of faithful and righteous believers. The visitors who arrive are welcomed with a serious countenance, expressing sorrow and pain at the death of the deceased, as well as gratitude to the guests for their condolences.

    Photographs of alleged prisoner abuse which Barack Obama is attempting to censor include images of apparent rape and sexual abuse, it has emerged.

    At least one picture shows an American soldier apparently raping a female prisoner while another is said to show a male translator raping a male detainee.

    Further photographs are said to depict sexual assaults on prisoners with objects including a truncheon, wire and a phosphorescent tube.

    Another apparently shows a female prisoner having her clothing forcibly removed to expose her breasts.

    Detail of the content emerged from Major General Antonio Taguba, the former army officer who conducted an inquiry into the Abu Ghraib jail in Iraq.

    Allegations of rape and abuse were included in his 2004 report but the fact there were photographs was never revealed. He has now confirmed their existence in an interview with the Daily Telegraph.

    The graphic nature of some of the images may explain the US President's attempts to block the release of an estimated 2,000 photographs from prisons in Iraq and Afghanistan despite an earlier promise to allow them to be published.

    Maj Gen Taguba, who retired in January 2007, said he supported the President's decision, adding: "These pictures show torture, abuse, rape and every indecency.

    "I am not sure what purpose their release would serve other than a legal one and the consequence would be to imperil our troops, the only protectors of our foreign policy, when we most need them, and British troops who are trying to build security in Afghanistan.

    "The mere description of these pictures is horrendous enough, take my word for it."

Gisteren schreef ik dit:

'Als het recht goed zou functioneren dan zou Madeleine Albright  zich in Den Haag moeten verantwoorden voor het plegen van oorlogsmisdrijven. 

Jose van Leeuwen emailde me het volgende bericht uit de Telegraaf:

 Amerikaanse oud-minister doet mee aan Haags instituut 

 DEN HAAG -  Oud-minister Madeleine Albright is bereid zitting te nemen in de raad van toezicht van een nieuw onderzoeks- en opleidingsinstituut in Den Haag. Het gaat om een nog op te richten Haagse instelling die in samenwerking met de Universiteit Leiden moet uitgroeien tot een van de belangrijkste opleidingen op het terrein van vrede, recht en internationale veiligheid. Dat heeft een woordvoerder van de gemeente Den Haag maandag bevestigd.

 De voorlopige werknaam van de op te richten instelling luidt Institute for Global Justice. Een commissie onder leiding van bestuursvoorzitter Dirk Jan van den Berg van de TU Delft werkt aan het ontwikkelingsplan voor het Institute for Global Justice. De commissie komt in juni met het plan naar buiten.

 Albright heeft haar medewerking persoonlijk toegezegd aan burgemeester Jozias van Aartsen (VVD) van Den Haag, aldus de woordvoerder. De twee kennen elkaar uit de tijd dat beiden minister van Buitenlandse Zaken waren, tijdens de tweede ambtstermijn van president Bill Clinton. Van Aartsen was toen minister van Buitenlandse Zaken in het tweede kabinet-Kok (1998-2002). Ze werden vrienden en hebben ook na hun ministerschap contact gehouden.

 Den Haag profileert zich de laatste jaren nadrukkelijk als internationale hoofdstad van vrede en recht. De stad huisvest inmiddels tientallen organisaties en instellingen op dit terrein, waaronder het Internationaal Gerechtshof, het Permanente Hof van Arbritage, het Internationale Strafhof, Europol en het Straftribunaal voor het voormalige Joegoslavië.'

 In 2002 schreef ik dit in een artikel voor het tijdschrift De Humanist:

 4 maart 2000 wees Denis Halliday, de voormalige VN-coordinator van het Humanitaire Programma in Irak het Westerse publiek erop dat wij de mensenrechten in Irak op grote schaal schenden. Na uit protest te zijn opgestapt verklaarde hij in The Guardian: 'Ik had de opdracht gekregen om een politiek te voeren die voldoet aan de definitie van genocide: een bewust beleid dat in feite meer dan een miljoen individuen, kinderen en volwassenen, heeft vermoord. We weten allemaal dat het regime, Saddam Hoessein, de prijs voor de economische sancties niet betaalt… Het zijn de gewone mensen die hun kinderen verliezen of hun ouders door gebrek aan gezuiverd water. Duidelijk is dat de Veiligheids Raad momenteel zijn boekje te buiten gaat, want zijn acties ondermijnen hier het eigen handvest… De geschiedenis zal de verantwoordelijken afstraffen.' Mei 1996 verscheen de toenmalige Amerikaanse ambassadrice bij de VN, Madeleine Albright, in het befaamde CBS programma '60 Minutes.' Haar werd een reactie gevraagd op een VN-rapport waarin melding werd gemaakt van het feit dat als gevolg van de sancties en de Amerikaanse en Britse bombardementen die de infrastructuur volledig hadden verwoest, meer dan een half miljoen Irakese kinderen onder de vijf jaar om het leven was gekomen. De programmamaakster voegde eraan toe: 'Dat zijn meer kinderen dan in Hiroshima stierven… Is het de prijs waard?' Albright antwoordde: 'Wij denken dat het de prijs waard is.' Toen programmamaakster Lesley Stahl aandrong en de ambassadrice vroeg of de Amerikaanse regering 'zelfs met de hongerdood' van kleuters akkoord ging, rechtvaardigde Albright deze genocidale politiek met de opmerking: 'Weet je Lesley… het is moeilijk voor mij om dit te zeggen, want ik ben een humaan mens, maar mijn eerste verantwoordelijkheid is om ervoor te zorgen dat Amerikaanse troepen niet weer opnieuw de Golfoorlog hoeven uit te vechten.' Met andere woorden: een ongewapend, hulpeloos kind wordt opgeofferd voor een getrainde militair die zich wel kan verdedigen. Burgers worden opgeofferd voor militairen, de omgekeerde wereld, meer dan 1000 jaar nadat in het jaar 975 in het Zuid-Franse Le Pui voor het eerst in de geschiedenis de bescherming van burgers tegen oorlogsgeweld werd vastgelegd. Nog geen zes maanden na haar uitspraak werd Madeleine Albright bevorderd tot minister van buitenlandse zaken. Vier jaar later confronteerde de Australische journalist John Pilger de Amerikaanse onderminister van buitenlandse zaken James Rubin met haar uitspraak. Zijn reactie kwam erop neer dat Pilger te 'idealistisch' was. 'Bij het uitvoeren van politiek beleid moet men een keuze maken tussen twee kwaden… en helaas zijn de gevolgen van de sancties groter dan we gehoopt hadden,' aldus Rubin. Hij adviseerde Pilger niet zo naïef te zijn omdat er nu eenmaal een 'echte wereld' bestaat waar 'werkelijke keuzes moeten worden gemaakt.'

 De Nederlandse kranten als de Telegraaf en de Volkskrant verzwijgen deze informatie, waardoor niet bekend wordt dat een van oorlogsmisdaden beschuldigde Amerikaanse politica in de raad van toezicht van 'een van de belangrijkste opleidingen op het terrein van vrede, recht en internationale veiligheid' zitting gaat nemen. Dat daardoor 'vrede, recht en internationale veiligheid'  een farce worden interesseert de commerciele massamedia niet, en speelt dus geen rol. En ook onze politici spelen het spelletje mee. Geen enkel Kamerlid komt op het idee om hier eens vragen over te stellen. De gedachte alleen al benauwt ze. Ze betalen Albright liever voor haar geweldige inzet.

 Ook de academici in Nederland die hun status ontlenen aan de mensenrechten zwijgen in alle talen, en zo sluit de cirkel van de macht zich.'

Dat schreef ik gisteren. Vervolgens emailde ik deze informatie naar een vooraanstaande Nederlandse academicus, een groot pleitbezorger van de mensenrechten.

Dit was zijn reactie:

Dag Stan,

 

Je weet vast dat ik deel uitmaak van de driekoppige

commissie die Den Haag over dit alles heeft geadviseerd.

Wij gaan overigens niet over het aantrekken van mensen als Madeleine Allbright, maar anders

dan jij vind ik dat geen verkeerde keuze. Verder zal een Raad van

Toezicht zich niet gaan bezighouden met de dagelijkse gang van zaken

binnen het instituut. Dus voor mij staat het helemaal niet vast dat

er geen onderzoek zou kunnen worden gedaan naar zaken als de

Israelische aanval op Gaza. Als de dagelijkse leiding dat nuttig

vindt, zal dat zeker gebeuren.

 

Kan het zijn dat de rest van je mails nogal op de man is?

zeker op de man c.q. vrouw. ik hecht namelijk grote waarde aan

persoonlijke verantwoordelijkheid. dat is voor mij in feite de kern

van de mensenrechten. die kunnen pas echt gewaarborgd zijn op het

moment dat het individu zich persoonlijk verantwoordelijk voelt voor

hetgeen hij doet of juist niet doet. Het is interessant om te

weten waarom jij als pleitbezorger van de mensenrechten Madeleine

Albright wel degelijk een goede keuze vindt ondanks haar uitspraak dat

de dood van meer dan een half miljoen Irakese kinderen onder de vijf

jaar 'de prijs waard'  was. Welke reden heb je daarvoor?

Wat betreft Albright: je mail over haar las ik, zij het 'cross', maar ik weet  

niet of het allemaal zo gezegd is. Dat zou ik verder moeten  

onderzoeken.

Nu ik wist dat hij mijn informatie niet serieus had bestudeerd, wees ik hem op het volgende:

Met die uitspraak was ik niet bekend. Daar laat ik het maar bij.

Wat wil ik hiermee nu zeggen? Het volgende: mensenrechten, beschaving in het algemeen, is in onze westerse cultuur vooral een instrumenteel wapen dat vanwege politieke overwegingen wel of niet gebruikt wordt. En omdat vooral de Nederlandse academici en de 'politiek literaire elite', zoals Hofland deze polderelite noemt, allereerst de consensus omarmen waarbij het kwaad in de ander wordt geprojecteerd, blijft deze elite vooral geleid worden door conformisme. En op het moment dat u of ik hen daarop betrap dan is hun enige reactie een donderende stilte, of in de woorden van deze academicus die zijn inkomen en status verdient met het bepleiten van het handhaven van de mensenrechten: 'Met die uitspraak was ik niet bekend. Daar laat ik het maar bij.' Vooral dat woordje 'maar'  is zo veelzeggend. Vindt u ook niet? En deze cultuur is volgens mevrouw Kluveld 'superieur', en zolang niemand dat tegenspreekt lijkt het ook zo. Mensenrechten is big business geworden.

Het was Socrates voor wie het Ken Uzelve het belangrijkste criterium was. Hoe kan een cultuur 'superieur' zijn wanneer het zichzelf niet kent en zelfs de behoefte daartoe niet heeft?

Mrs Clinton: "The president wants to see a stop to settlements"

Israel will continue to allow some construction in West Bank settlements despite US calls for a freeze on its work, a government spokesman says.
Mark Regev said the fate of the settlements should be decided in peace negotiations with the Palestinians.
His remarks appear to be a rebuff to US Secretary of State Hillary Clinton, who said all such activity should cease.
Her comments came hours before Palestinian President Mahmoud Abbas was due to meet US President Barack Obama.
Mrs Clinton said on Wednesday there must be no exceptions to President Obama's demands for Israel's settlement work to stop.
Speaking to reporters after a meeting with her Egyptian counterpart, Mrs Clinton said that the president was "very clear" with Prime Minister Benjamin Netanyahu at their recent meeting that there should be a stop to all settlements.

"Not some settlements, not outposts, not natural growth exceptions," Mrs Clinton said.
"We think it is in the best interest of the effort that we are engaged in that settlement expansion cease."
Correspondents say it is the first time in years that US officials have been so vocal in calling for a settlement freeze in the Palestinian territories.

Rival Livni is vital to Netanyahu, say analysts

NAZARETH, ISRAEL // Pressure is mounting on Benjamin Netanyahu, the Israeli prime minister, to bring the opposition leader Tzipi Livni into the government after last week’s difficult meeting with the US president, according to senior analysts.

 

Yaron Ezrahi, a political science professor at Hebrew University in Jerusalem, said Mr Netanyahu now understood that he faced a stark choice between clashing with the White House and ditching the far-right parties in his coalition.

 

During the talks in Washington, Barack Obama said he expected an immediate halt to settlement building, a move rejected by Mr Netanyahu’s main coalition partners and many in his own right-wing Likud Party.

 

The Israeli prime minister hinted this week he will probably renew the call for Ms Livni, the leader of Kadima, a centrist party, to join the coalition after his failure to tempt her into a unity government following February’s general election.

 

Highlighting the alleged threat of Iran’s gaining a nuclear warhead as the main danger facing Israel, he told his party on Monday the priority was to “reach as broad a national unity as possible to repel the danger. Our relations with the United States are important and we must preserve them”.

 

Prof Ezrahi said: “As long as Netanyahu didn’t know how obstinate Obama was going to be, he could afford to ignore all the signs coming from the White House. But after the talks in Washington, Netanyahu’s hand is considerably weaker.

 

“Netanyahu and Livni are now indispensable to each other.”

 

Tensions within the current coalition have mounted over the past week, particularly over indications that Mr Netanyahu may try to dismantle a handful of tiny outpost settlements as a minimal concession to the US administration.

 

The White House is demanding an immediate freeze on all settlement expansion in the West Bank to prepare the ground for a peace deal with the Palestinians.

 

Mr Netanyahu is opposed to the creation of a Palestinian state and is offering a much vaguer “economic peace”.

 

Yesterday, Dan Meridor, the intelligence agencies minister, met US officials in Britain in what the Israeli media described as an attempt to persuade the White House to allow continued expansion of the larger settlements in return for a crackdown on two dozen outposts.

 

Ehud Barak, the defence minister and leader of the much-diminished left-wing Labor party, is expected to convey the same message on a trip to Washington next week.

 

Last Thursday Mr Barak sent in security forces to dismantle one outpost, Maoz Esther, east of Ramallah, that consisted of five huts and two tents. There are more than 100 similar outposts across the West Bank, ostensibly unauthorised by the government and housing a few thousand settlers.

 

On Monday Mr Barak also approved “zoning notices” against a further 10 outposts, setting in motion proceedings that could eventually lead to their demolition.

 

He promised to dismantle a total of 26 outposts, a pledge Israel made to the previous US administration of George W Bush but has yet to fulfil.

 

Observers, however, were largely unimpressed by the supposedly tough new stance. It was the fourth time Maoz Esther has been dismantled and, as on previous occasions, the settlers were allowed back a few hours later.

 

Uri Avnery, leader of the Gush Shalom peace group, accused Mr Barak of conducting only “a performance of ‘demolishing outposts’”.

 

Nehemia Strasler, of the liberal Haaretz newspaper, argued that the spectacle was meant to “divert [US] attention from the construction taking place all over the West Bank”.

 

At a cabinet meeting on Sunday, the right-wing parties vied in denouncing Mr Barak, with one calling his move a “witch-hunt” against the settlers. The next day Mr Netanyahu tried to reassure his party by suggesting the crackdown on outposts would win US backing for Israel’s hard line on Iran.

 

Writing in Haaretz, Aluf Benn, another columnist for the paper, noted: “Netanyahu is in a trap: the more he tries to persuade Obama he can provide the diplomatic goods, the quicker his coalition will expire.”

 

Mr Netanyahu’s only saviour, according to Prof Ezrahi, is his chief rival for power, Ms Livni. He said the Israeli public expected unity from senior politicians during times of crisis and neither Mr Netanyahu nor Ms Livni would want to be seen wrecking the chances of a unity government.

 

“Israelis believe the country’s existence totally depends on US support and will judge harshly any leader who risks jeopardising that relationship. That is the most pressing political constraint on Mr Netanyahu.”

 

Ms Livni added to the pressure on Mr Netanyahu this week. She accused him of “bad management” and said Israel was “witnessing signs of a diplomatic collapse”.

 

Yesterday she criticised the government’s preference for the road map, a US peace plan from 2003, saying it delayed direct talks with the Palestinians for too long.

 

“Refraining from talking will bring us to a situation in which we won’t have a partner for talks,” she told Army Radio.

 

Ms Livni faces her own political constraints. Shaul Mofaz, her main challenger to lead Kadima, has been lobbying among colleagues against her earlier refusal to join the coalition.

 

He added that most Kadima legislators privately agreed with him on the need for a unity government.

It spares neither the planet itself, nor anyone living on it anywhere. Abstract because deriving from the sole logic of the pursuit of profit (as cold as the freezer), it threatens to make obsolete all other sets of belief, along with their traditions of facing the cruelty of life with dignity and some flashes of hope.'

Wijsheid is zoveel subtieler dan de verpolitiekte beweringen die ideologische opiniemakers via de commerciele massamedia verspreiden.
