The Palestinian population in Gaza has seen over the years increasing restrictions on the movements of people, goods and services to and from Gaza as a result of ongoing armed hostilities between militants and Israeli Defense Forces. International humanitarian law is designed to address some of the preeminent humanitarian issues in such situations. The purpose of this live seminar is to look at the current situation through a legal lens. What are the international legal frameworks applicable to the Gaza Strip? What is the status of Gaza under these laws? And what does international law actually have to say about obligations with respect to access and the movement of people, goods, and services into and out of Gaza? These questions are central to the practical challenges faced by humanitarian professionals and policymakers working in and around the Gaza Strip, as every aspect of life in Gaza - from basic nutrition, medical care and education to social and economic development - is tied to the reality of who and what moves into and out of the territory and where, when, and how this movement takes place. This Live Seminar will outline the applicable international law and explore the implications of various legal arguments, particularly with regard to the obligations of the parties involved. Claude Bruderlein, Director of the Program at Harvard, and Naz Modirzadeh, Senior Associate at the Program, will host the Seminar. Expert practitioners from the field will join in the discussion. During the event, online participants will have the opportunity to submit questions to the hosts and join in live discussion.'

Today the Stockholm community council in Sweden announced that the French company Veolia who has been the current operator at the Subway's in Stockholm County for 10 years lost the contract to the MTR-cooperation.
The contracts for the coming 8 years is worth 3,5 Billion EURO and has been the biggest ongoing public contract procurement process in Europe.
Although the board for county's public transportation ensured the decision was based on commercial factors the debate about Veolias involvement in a controversial tramway project in Jerusalem (Jerusalem light railway) has been intense in Swedish media.
The tramway connecting the Israeli west Jerusalem with illegal Israeli settlements on occupied Palestinian territory has triggered discussions about Veolia's ethical policy. Public protests against Veolia has brought the attention to the dilemma of operating public services when you at he same time are involved in politically controversial activities.
As late as the day before the decision the community council received lists with thousands of signatories from people demanding the county council to choose an operator who should not be associated with violations of international humanitarian law.
- This is clearly another sign of the importance for commercial actors not to have their brand associated to unethical behaviour, in the case of illegal settlements on occupied palestinian territory we can already see a trend of international companies who are moving out their operations from settlements, says Joakim Wohlfeil, at the Swedish development organization Diakonia.

'Bush, Rumsfeld should be pursued for torture: UN rapporteur

BERLIN, Jan 20, 2009 (AFP) -
The UN's special torture rapporteur called on the US Tuesday to pursue former president George W. Bush and defence secretary Donald Rumsfeld for torture and bad treatment of Guantanamo prisoners.
"Judicially speaking, the United States has a clear obligation" to bring proceedings against Bush and Rumsfeld, the United Nations Special Rapporteur on Torture Manfred Nowak said, in remarks to be broadcast on Germany's ZDF television Tuesday evening.
He noted Washington had ratified the UN convention on torture which required "all means, particularly penal law" to be used to bring proceedings against those violating it.
"We have all these documents that are now publicly available that prove that these methods of interrogation were intentionally ordered by Rumsfeld," against detainees at the US prison facility in Guantanamo Bay, Cuba, Nowak said.
"But obviously the highest authorities in the United States were aware of this," added Nowak, who authored a UN investigation report on the Guantanamo prison.
Bush stepped down from power Tuesday, with Barack Obama becoming the 44th president of the United States.
Asked about chances to bring legal action against Bush and Rumsfeld, Nowak said: "In principle yes. I think the evidence is on the table."
At issue, however, is whether "American law will recognise these forms of torture."
A bipartisan Senate report released last month found Rumsfeld and other top administration officials responsible for abuse of Guantanamo detainees in US custody.
It said Rumsfeld authorized harsh interrogation techniques on December 2, 2002 at the Guantanamo prison, although he ruled them out a month later.
The coercive measures were based on a document signed by Bush in February, 2002.
French, German and US rights groups have previously said they wanted to bring legal action against Rumsfeld.'

De Nuance van de NRC 78

Vorige week woensdag kreeg de joods-Israelische hoogleraar Martin Levi van Crevelt zes kolommen breed de ruimte in de NRC om zijn fascistische gedachtegoed te verspreiden. Zo zette deze ultrazionist onder andere het volgende trots uiteen: 'Anders dan meestal wordt aangenomen, hebben de Israëliërs dat conflict op hun sloffen gewonnen. Juist omdát ze disproportioneel reageerden op de gevangenneming van twee van hun soldaten en de dood van zes anderen, is Hezbollah’s wil om aan te vallen gebroken.' Disproportioneel geweld dus gericht tegen de Palestijnse burgerbevolking, omdat zo beargumenteerde Van Creveld: 'het laatste wat de Israeliers willen is de steegjes van Gaza, Rafah en Khan Yunis bestormen.' En dus schoten tanks vanaf afstand alles wat ze konden raken plat, met als gevolg dat eenderde van het aantal doden kind is, en meer dan de helft burger, en dat omdat de Israelische soldaten te laf zijn om de vijand te 'bestormen'. Het 'disproportioneel' geweld in de hoop een verzetsstrijder te treffen en op die manier honderden burgers vermoorden en duizenden verwonden is, zoals bekend, een oorlogsmisdaad. Maar dat feit is in de extremistische gedachtewereld van Van Creveld een te verwaarlozen detail. Kinderen, vrouwen, bejaarden lopen in deze criminele Israelische strategie nu eenmaal 'de kans een zeer hoge prijs te betalen. Mais c'est la guerre.' Deze barbarij mag allemaal van de NRC gepropageerd worden. Maar waar niet op gewezen mocht worden van de NRC was dat dit oorlogsmisdaden zijn. Dat paste niet in de pro-Israel propaganda. Het gedocumenteerd bewijzen dat het hier zware schendingen van bijvoorbeeld de Geneefse Conventies betreft was niet relevant voor de krant om de geest van hun lezers te scherpen, aangezien in de ogen van de redactie deze informatie: 'weinig nieuwe gezichtspunten bevat.' Dit alles in tegenstelling tot het pleidooi van Van Creveld. De NRC-lezer heeft kennelijk dringend behoefte aan zijn soort informatie, en wenst niet lastig gevallen te worden door trivialiteiten als mensenrechten en de Geneefse Conventies.

Weet de NRC niet wat de consequenties zijn van deze strategie? Jawel, want ook de NRC heeft de volgende woorden van premier Olmert kunnen lezen: 'De Libanese oorlog zal de geschiedenis ingaan als de eerste oorlog waarin het militair leiderschap begreep dat klassieke oorlogsvoering achterhaald is… Maar de ware les is… dat in hedendaagse oorlogen het thuisfront het front is, het thuisfront is bij de strijd betrokken.’ En premier Olmert heeft gelijk, een moderne oorlog is geen oorlog meer, het is terreur tegen de burgerbevolking, 'het thuisfront is bij de strijd betrokken' aangezien het 'thuisfront het front is.'

En hoe weet ik dat de NRC hiervan op de hoogte was? Simpel, ik heb de afgelopen weken alles over Israel naar de Nederlandse commerciele massamedia doorgestuurd, zodat ze later niet kunnen zeggen dat ze van niets geweten hebben. Of ze het gelezen hebben, weet ik niet. Misschien hebben ze het weggegooid, maar dan is duidelijk dat ze deze informatie niet wilden lezen. De vraag is nu waarom de krant die zegt de nuance te zoeken de informatie van premier Olmert niet als uitgangspunt nam bij het beoordelen van de fascistische gedachten van Van Creveld. 'Mais c'est la guerre', misschien was dat het, maar dan toch, beste collega's, als er meer dan 1200 Joden in Israel waren gedood, van wie eenderde kind was, zouden jullie dan een Palestijn hebben laten schrijven: 'Mais c'est la guerre.' Nee, natuurlijk, met andere woorden: voor de NRC-redactie is het leven van een Joods kind belangrijker dan het leven van een Palestijns kind. En dat nu, beste collega's, is een schoolvoorbeeld van een bepaald soort racisme.

Obama 75

Obama: 'To the Muslim world, we seek a new way forward, based on mutual interest and mutual respect.' We zijn benieuwd, maar uiterst sceptisch. Het betekent namelijk het intomen van Israel als schurkenstaat en 'de joodse staat' dwingen het internationaal recht te respecteren.

President Obama zei ondermeer dit:


'Now, there are some who question the scale of our ambitions - who suggest that our system cannot tolerate too many big plans. Their memories are short. For they have forgotten what this country has already done; what free men and women can achieve when imagination is joined to common purpose, and necessity to courage.
What the cynics fail to understand is that the ground has shifted beneath them - that the stale political arguments that have consumed us for so long no longer apply. The question we ask today is not whether our government is too big or too small, but whether it works - whether it helps families find jobs at a decent wage, care they can afford, a retirement that is dignified. Where the answer is yes, we intend to move forward. Where the answer is no, programs will end. And those of us who manage the public's dollars will be held to account - to spend wisely, reform bad habits, and do our business in the light of day - because only then can we restore the vital trust between a people and their government.'



De vraag is alleen hoe een failliet rijk dat meer dan eenderde van zijn federale begroting besteedt aan iets dat officieel de nationale veiligheid heet, dit militair-industrieel complex met zijn nauwe relaties met het Congres, aan banden gaat leggen.



Het volgende verklaarde president Eisenhower na acht jaar presidentschap: “We annually spend on military security more than the net income of allUnited States corporations. Eisenhower in a televised speech 1961



Die macht is meer dan een halve eeuw later alleen maar enorm gegroeid. Hoe leg je die macht aan banden en alle lobbygroepen die ervan profiteren. Nagenoeg alle Congresleden krijgen geld van een of andere lobbygroep, waarvan de machtigste de olielobby, de wapenlobby, de Israellobby, de landbouwlobby zijn. Dit hele corrupte systeem en een president die door de Amerikaanse elite naar voren is geschoven.

Obama 74

Een begaafd spreker, met de dictie van Martin Luther King en de woorden van een visionair. Nu de daden nog, en die zullen veel magerder zijn, want Obama weet als alle anderen in de politieke macht dat de ware macht elders ligt en die moet nu meewerken aan een nieuw Verenigde Staten. De ware macht zal even zijn jacht op rijkdommen moeten inperken. En dat zal die macht ook doen, want anders was Obama geen president geweest. Of het voldoende is om het failliete rijk en de al even failliete bevolking uit het moeras te trekken weet niemand. We zullen zien, en de rest is de propaganda van betaalde opiniemakers.

De Nuance van de NRC 77

Vandaag schreef ik dit: 'De vraag is dit: waarom kreeg Van Creveld zes kolommen de ruimte in de NRC om zijn disrepect voor het oorlogsrecht en de mensenrechten te etaleren, terwijl Nederlandse juristen, deskundigen op het gebied van het internationaal recht, van dezelfde redactie acht dagen eerder vernamen dat er geen behoefte was aan een artikel over de Israelische schendingen van het internationaal recht 'daar wij van mening zijn dat hij weinig nieuwe gezichtspunten bevat... Een lezer van mijn weblog e-mailde me dit over Anna Visser: 'Stelselmatig en consistent weigert zij stukjes te plaatsen die ondertekend zijn door namen van migranten, hoe hoogwaardig en actueel ook. Bijdrages daartegenover van Jan, Paul, Piet, Klaas, Han, Jos en Marietje, hoe ondermaats ook worden wel gehonoreerd. Sterker nog, zelfs goed gedocumenteerde reacties op dergelijke mediocre stukjes, van de hand van migranten, worden geweigerd. En Visser mailt zo snel haar automatische afwijzende tekst na verzending, dat je redelijkerwijs ervan uit kunt gaan dat zij niet eens de tekst heeft gelezen en alleen naar de naam van de afzender heeft gekeken. Dit is proefondervindelijk vastgesteld. Het gaat weliswaar en wellicht slechts om één medewerkster. Dit neemt de verantwoordelijkheid van de krant niet weg. Het is ook niet uitgesloten dat iedere krant en elk medium zijn Anna Visser heeft.
