Het feit dat Israel bewust van plan was om oorlogsmisdaden te plegen, was de voornaamste reden om journalisten te verbieden het oorlogsgebied binnen te komen. Bewust, stel ik, op grond van uitspraken van Israelische militairen als GOC Northern Command Gadi Eisenkot. Generaal Eisenkot verklaarde begin oktober 2008 tegenover de Israelische krant Yedioth Ahronot:
'We will wield disproportionate power against every village from which shots are fired on Israel, and cause immense damage and destruction. From our perspective, these are military bases," he said. "This isn't a suggestion. This is a plan that has already been authorized."Colonel (Res.) Gabriel Siboni recently authored a report through Tel Aviv University's Institute for National Security Studies backing Eisenkot's statements.'
Deze bewust geplande militaire strategie van Israel om disproportioneel geweld te gebruiken waarbij ook de Palestijnse burgerbevolking wordt getroffen, is volgens de juriste Heikelien Verrijn Stuart, specialist in internationaal recht, een oorlogsmisdaad. In een artikel dat eind van de maand in het Nederlands Juristenblad verschijnt, wijst ze op een aantal internationale verdragen die de bescherming van de burgerbevolking tegen dit soort terreur regelt. Overigens informatie die de NRC weigerde te publiceren.
'Israƫl zet zich schrap tegen aanklachten

Israƫl houdt er rekening mee dat pro-Palestijnse organisaties in het westen hooggeplaatste Israƫlische militairen gaan aanklagen voor oorlogsmisdaden. In afwachting van de schadeclaims is het ministerie van Defensie materiaal aan het verzamelen om het tegendeel te bewijzen, zeggen regeringsbronnen. Israƫl benadrukt dat het offensief tegen Hamas in de Gazastrook zelfverdediging was en dat burgerdoden zoveel mogelijk zijn vermeden. Burgers Bij de strijd zijn de afgelopen drie weken onder de Palestijnen ruim 1250 slachtoffers gevallen, van wie naar schatting meer dan de helft burgers. Het afgelopen weekeinde kondigde zowel Israƫl als Hamas een staakt-het-vuren aan.'

Ronny Naftaniel van het CIDI 9


Over het recente antisemitisme zei Ronny Naftaniel: ''Het is schokkend dat dit in Nederland gebeurt. Tot nu toe is het nog redelijk goed gegaan, maar de incidenten zijn onacceptabel." Ronny Naftaniel heeft gelijk, antisemitische daden tegen joden zijn onacceptabel, en dat geldt ook voor antisemitische uitlatingen tegen Arabieren, zoals die in Nederland ongestoord in het openbaar kunnen worden gedaan. En even onacceptabel is het dat Naftaniel zelf als directeur van de zionistische organisatie het CIDI in het openbaar het Israelisch geweld tegen de Palestijnse burgerbevolking betiteld als 'gerechtvaardigd'. Hij zou dat nooit hebben verklaard als Palestijnen meer dan 1300 joods-Israeli's hadden gedood. Het feit dat hij een onderscheid maakt tekent de manier waarop hij over Arabieren denkt. Het zijn mensen als Naftaniel die het altijd bestaande antisemitisme voeden. Het zou verstandig zijn als hij zich distantieerde van de Israelische terreur en als hij het internationaal recht zou gaan respecteren. Geen enkele Nederlander kan met fatsoen oorlogsmisdaden goedpraten.

Dat schrijft de Israelische vredesactivist Uri Avnery en oud-Knessetlid, en oprichter van de vredesbeweging Gush Shalom, op zijn weblog.

'Israel accused of war crimes over 12-hour assault on Gaza village
White flags ignored and houses bulldozed with families inside, claim residents

Israel stands accused of perpetrating a series of war crimes during a sustained 12-hour assault on a village in southern Gaza last week in which 14 people died.
In testimony collected from residents of the village of Khuza'a by the Observer, it is claimed that Israeli soldiers entering the village:
• attempted to bulldoze houses with civilians inside;
• killed civilians trying to escape under the protection of white flags;
• opened fire on an ambulance attempting to reach the wounded;
• used indiscriminate force in a civilian area and fired white phosphorus shells.
If the allegations are upheld, all the incidents would constitute breaches of the Geneva conventions.
The denunciations over what happened in Khuza'a follow repeated claims of possible human rights violations from the Red Cross, the UN and human rights organisations.
The Israeli army announced yesterday that it was investigating "at the highest level" five other attacks against civilians in Gaza, involving two UN facilities and a hospital. It added that in all cases initial investigations suggested soldiers were responding to fire. "These claims of war crimes are not supported by the slightest piece of evidence," said Yigal Palmor, an Israeli foreign ministry spokesman.
Concern over what occurred in the village of Khuza'a in the early hours of Tuesday was first raised by the Israeli human rights group B'Tselem. Although an Israeli military spokesman said he had "no information that this alleged incident took place", witness statements collected by the Observer are consistent and match testimony gathered by B'Tselem.
There is also strong visible evidence that Khuza'a came under a sustained attack from tanks and bulldozers that smashed some buildings to pieces.
Pictures taken by photographer Bruno Stevens in the aftermath show heavy damage - and still burning phosphorus. "What I can tell you is that many, many houses were shelled and that they used white phosphorus," said Stevens yesterday, one of the first western journalists to get into Gaza. "It appears to have been indiscriminate." Stevens added that homes near the village that had not been hit by shell fire had been set on fire.
The village of Khuza'a is around 500 metres from the border with Israel. According to B'Tselem, its field researcher in Gaza was contacted last Tuesday by resident Munir Shafik al-Najar, who said that Israeli bulldozers had begun destroying homes at 2.30am.
When Rawhiya al-Najar, aged 50, stepped out of her house waving a white flag, so that the rest of the family could leave the house, she was allegedly shot by Israeli soldiers nearby.
The second alleged incident was on Tuesday afternoon, when Israeli troops ordered 30 residents to leave their homes and walk to a school in the village centre. After travelling 20 metres, troops fired on the group, allegedly killing three.
Further detailed accounts of what occurred were supplied in interviews given to a Palestinian researcher who has been working for the Observer, following the decision by Israel to ban foreign media from the Gaza Strip. Iman al-Najar, 29, said she watched as bulldozers started to destroy neighbours' homes and saw terrified villagers flee from their houses as masonry collapsed.
"By 6am the tanks and bulldozers had reached our house," Iman recalled. "We went on the roofs and tried to show we were civilians with white flags. Everyone was carrying a white flag. We told them we are civilians. We don't have any weapons. The soldiers started to destroy the houses even if the people were in them." Describing the death of Rawhiya, Iman says they were ordered by Israeli soldiers to move to the centre of the town. As they did, Israeli troops opened fire. Rawhiya was at the front of the group, says Iman.
Marwan Abu Raeda, 40, a paramedic working for the Nasser hospital in Khan Younis, said: "At 8am we received a phone call from Khuza'a. They told us about the injured woman. I went immediately. I was 60 or 70 metres away from the injured woman when the Israeli forces started to shoot at me." As he drove into another street, he came under fire again. Twelve hours later, when Rawhiya was finally reached, she was dead.
Iman said she ended up in an area of rubble where a large group of people had sought cover in a deep hole among the debris of demolished houses. It is then, she says, that bulldozers began to push the rubble from each side. "They wanted to bury us alive," she said.'

Impeding Medical Relief in the Gaza Strip: Israel's War Crimes against the Injured

As a Palestinian organisation dedicated to the protection and promotion of human rights in the Occupied Palestinian Territory (OPT), Al-Haq is dismayed by the failure of Israeli occupying forces to allow medical assistance to thousands of stranded Palestinians who have been critically wounded in its attacks during "Operation Cast Lead" in the besieged Gaza Strip. The following is but one of hundreds of other ominous stories which describe the fate of wounded Palestinians. It highlights the callous disregard of the Israeli occupying forces for the lives of Palestinians in the Gaza Strip and Israel's apparent contempt for its obligations under international humanitarian law. Incidents in which medical aid is denied to persons protected under international humanitarian law, such as that which follows, present prima facie cases of war crimes for which individuals should be held criminally responsible.

Summary of Facts

On Friday, 16 January 2009, between 1:00 and 1:30 pm, Mohammed Shurrab, 64 years of age, and two of his sons, Kassab and Ibrahim, aged 28 and 18, respectively, were returning by jeep from their agricultural land in al-Fukhara, approximately 500 metres away from the Israeli fence on the eastern border of the Gaza Strip. At a distance of 50 metres from their home, their jeep came under machine gun fire from Israeli occupying forces in the area. Mohammad was shot in the left arm and Ibrahim was shot in the leg. The elder son, Kassab, sustained a fatal bullet wound to the chest, dying after getting out of the car, running ten metres and falling. Mohammad and Ibrahim, continuing to bleed from their wounds, remained in their jeep for two hours and then, fearing for their safety, decided to move to another location, returning to the jeep after half an hour.

Mohammad contacted the media, the International Committee of the Red Cross (ICRC) and a number of NGOs via mobile phone in order to acquire medical assistance. Other agencies such as Physicians for Human Rights-Israel were also aware of the dire circumstances of the three and attempted on several occasions to negotiate their transport to a hospital. Israeli occupying forces denied medical relief agencies clearance to reach them until sometime between 11:00 am and 12:00 pm on Saturday, 17 January 2009, almost 24 hours after Mohammad, Ibrahim and Kassab had been shot. Earlier that morning, Ibrahim had succumbed to his wound and died. Thus, Mohammad and the bodies of his two sons were transported by an ambulance to the Gaza European Hospital, located only 1.5 kilometres away from where they had come under attack.

The three were shot during a so-called "lull" in Israeli ground operations. A daily three-hour lull was agreed to by Israeli forces on Wednesday, 7 January 2009 and is meant to allow humanitarian relief to enter and be distributed in the Gaza Strip.

Legal Analysis

Under customary international humanitarian law, the wounded are protected persons and must receive, to the fullest extent practicable and with the least possible delay, the medical care and attention required by their conditions. Moreover, no distinction can be made among the wounded except on medical grounds. While the ICRC must seek permission from Israeli occupying forces in order to enter zones to care for and collect injured persons, such permission must not be denied arbitrarily. The problems reported by the ICRC in accessing Mohammad and Ibrahim along with other reports by the ICRC and other recognised medical relief agencies, in this and other cases, indicate a policy of arbitrarily denying medical care to protected persons.

The denial of medical treatment to protected persons is a war crime that may amount to the grave breach of the Fourth Geneva Convention of wilfully causing great suffering or serious injury to body or health. The disregard by Israeli occupying forces for the lives of Palestinians in instances where it denies medical access to them and death results may also amount to the grave breach of wilful killing. Grave breaches, as listed under Article 147 of the Fourth Geneva Convention, are the most serious infringements of the laws and customs of war.

The jurisprudence of the International Criminal Tribunal for the Former Yugoslavia (ICTY) has confirmed that both the crime of wilfully causing great suffering or serious injury to body or health and the crime of wilful killing can be crimes of omission. In the case above, deaths were the foreseeable outcome of an omission – the non-provision of safe passage to medical personnel.

In interpreting the intent required to meet the threshold of "wilful," the Trial Chamber in the ICTY's Delalic case, held that "the necessary intent (…) is present where there is demonstrated an intention on the part of the accused to kill, or inflict serious injury in reckless disregard of human life." The intention to kill or cause great suffering or serious injury can, in the present case, be inferred from the fact that multiple agencies had informed Israeli occupying forces of the gravity of the injuries of the three and yet safe passage of medical transports was not granted.

Although not the case in this specific example, in addition to denial of access to the wounded, medical relief agencies are also widely reporting being fired upon by Israeli occupying forces, often in circumstances where time is of the essence due to the critical condition of the wounded. Under customary international humanitarian law, attacks on medical personnel, medical units and medical transports exclusively assigned to carry out medical functions are also prohibited.

In light of the clear emergence of a policy of impeding medical care to protected persons in the Gaza Strip, Al-Haq urges the following:

The European Union (EU), as a major donor of humanitarian assistance to the Palestinian people, in addition to the individual member States of the EU, to pressure Israel for safe and unimpeded humanitarian access to all injured persons in the Gaza Strip; and
The High Contracting Parties to the Fourth Geneva Convention to take measures to ensure respect for the Fourth Geneva Convention under Article 1, and to hold perpetrators of grave breaches responsible under Article 146.'

Ik ga ervanuit dat hij het heeft over joden in Israel, maar dan is de vraag: waar zijn die slachtoffer van? De enige rationele conclusie is dat zij slachtoffer zijn van de door henzelf gekozen zionistische leiders die al 40 jaar lang in strijd met het internationaal recht weigeren de bezette Palestijnse gebieden te ontruimen, en al 60 jaar lang in strijd met het internationaal recht weigeren de door hen verdreven Palestijnen te laten terugkeren naar hun woonplaatsen. Door dat onrecht en het feit dat de zionisten Palestijns land blijven stelen, gaat het conflict door, moeten de Palestijnen zich blijven verzetten tegen de landroof, bezetting en belegering.
Intussen is Israel verandert in een racistische schurkenstaat die doet alsof het boven het recht staat. Ik sprak daarover met Eitan Bronstein, de joodse directeur van Zochrot, een in 2002 opgerichte IsraĆ«lische organisatie die de joods-IsraĆ«lische bevolking bewust wil maken van de Palestijnse ‘Nakba, de Palestijnse catastrofe van 1948… door die te herdenken, erover te getuigen, te erkennen en te helen.’
Hij zei dit tegen me: 'De zionisten van het eerste uur bijvoorbeeld, die door en door geseculariseerd waren, gebruikten de religieuze mythologie om joden te mobiliseren, en maakten van een geloof een politiek. Het probleem is echter niet het judaĆÆsme, maar de zionistische overtuiging dat IsraĆ«l een exclusief Joodse staat moet zijn. Omdat men een Joodse natie mogelijk wilde maken, moest men alle niet-Joden verdrijven. Een etnische zuivering was onvermijdelijk om de zionistische droom te verwezenlijken. En omdat de zionisten de oorspronkelijke bewoners hebben verdreven en weigeren hen te laten terugkeren, is vrede niet mogelijk. Daar komt nog bij dat de zionisten doorgaan met het in beslag nemen van nog meer Palestijns land. Dat is in feite het hele probleem. Het verziekt alle verhoudingen, ik bedoel, hier in Tel Aviv merk je het niet zo erg, dit is een open stad, maar zodra je in Jeruzalem bent voel je racisme op straat. Je ziet ook op de tentoonstellingen van de soldaten van Breaking the Silence, die zich tegen de terreur van de bezetting keren, dat het verwezenlijken van het zionisme jongeren ontmenselijkt. Al meer dan tachtig jaar geleden schreef een van de grondleggers van de Joodse staat, Zeev Jabotinsky, dat de Palestijnen nooit een exclusief Joodse staat zouden accepteren omdat dit onmiddellijk hun eigen ondergang zou betekenen. Hij pleitte daarom voor een “ijzeren muur, dat wil zeggen de vestiging in Palestina van een macht die op geen enkele manier zal worden beĆÆnvloed door Arabische druk’’. En zo is het ook gebeurd, we hebben nu de muur van de IsraĆ«lische strijdkrachten en ook nog eens de betonnen muur, die ons fysiek scheidt van onze omgeving. Nogmaals, het is duidelijk dat een Joodse staat Ć©n vrede een onoverbrugbare tegenstelling vormen. Ik ben het volledig eens met de IsraĆ«lische historicus Benny Morris, die in een interview verklaarde dat het zionisme geen vrede kan brengen. En al die zogenaamde linkse politici die beweren dat dit wel kan, bedriegen de bevolking.’

Op zijn beurt schreef de vooraanstaande joods-IsraĆ«lische columnist B. Michael in het dagblad Yediot Ahararonot: ‘Het lijdt geen twijfel dat het historische pad van het Joodse volk in de zestig jaar die 1942 scheidt van 2002 kan dienen als materiaal voor aangrijpende historische en sociologische onderzoeken. In zestig korte jaren, van degenen die opgesloten werden in getto’s tot degenen die anderen opsluiten. In zestig korte jaren, van degenen die gebrandmerkt en genummerd werden tot degenen die brandmerken en nummeren. In zestig jaren, van degenen die in rijen met de handen in de lucht achter elkaar lopen tot degenen die anderen in rijen met de handen in de lucht laten lopen… Eindelijk! We zijn niet langer een ander en bizar volk met een lichte huidskleur en een wijze blik, maar wrede soldaten zoals iedereen. Eindelijk zijn we gelijk aan alle andere naties.’
De vraag is dus waar Ronny Naftaniel het precies over heeft wanneer hij dit zegt: 'Schoolkinderen moeten joden ook weer als slachtoffer leren zien. De tendens is nu dat men, door het conflict in Israƫl, joden als daders ziet.' Maar juist dat vergat de pro-Israel interviewster, Nausicaa Marbe, te vragen. Dat pastte niet in het propagandapraatje.

Trouw constateert verbaast dat de Nederlandse bevolking niet langer massaal achter de Israelische terreur staat.:

'Steun voor Israƫl spreekt niet meer vanzelf

In de Nederlandse publieke opinie over Israƫl is nogal wat veranderd in de afgelopen decennia. De vanzelfsprekende verbondenheid met het Bijbelse land is verdwenen.
Een jonge man zwiert over het nog net beschaatsbare ijs van de Grote Poel, een meertje achter het stadhuis van Amstelveen. In zijn handen een vlaggenstok met daaraan, eendrachtig verbonden, de Nederlandse en IsraĆ«lische vlag. De man is een van de deelnemers aan een schaatsactie, georganiseerd door joodse en christelijke organisaties. Doel: pleiten voor een veilig IsraĆ«l en het inzamelen van geld voor de slachtoffers van de gewelddadigheden in Gaza en IsraĆ«l. ’Sjaal-om’, heet de actie, als knipoog naar dat beroemde woord uit het Ivriet dat vrede betekent, shalom.
Druk is het niet bij de Grote Poel. Op de wal kijkt een handvol mensen toe.
Sinds de aanval van IsraĆ«l op de Gazastrook, drie weken geleden, is er veel meer gedemonstreerd. Maar de meeste van die acties waren niet pro-IsraĆ«lisch, maar pro-Palestijns – of, misschien beter: anti-IsraĆ«lisch – en die demonstraties trokken veel meer aandacht. Een Kamerdelegatie kreeg dinsdag een door 3500 mensen ondertekende petitie aangeboden met de oproep om niet alleen de raketbeschietingen vanuit Gaza, maar ook het in hun ogen disproportionele IsraĆ«lische geweld te veroordelen.
In de Nederlandse publieke opinie over Israƫl is nogal wat veranderd in de afgelopen decennia.'
