Burn After Reading

So that... that is it than? No one else really knows anything.

Jezus fucking christ. What do we learn, Palmer?

Palmer: I don't know sir.

I don't fucking know either. I guess we learned not to do it again.

Palmer: Yes sir.

I am fucked if I know what we did.

Palmer: Yes sir, it's hard to say.

Zoals gesteld: BRILJANT!

En Burn After Reading.

Acquire Your Own Superpowers: Go See This Movie

A big obstacle to turning Americans on to the idea of action to support the human rights of Palestinians is that the situation appears to many as, a) far away and, b) totally hopeless. Try to talk up the issue, and you are likely to get a look that says, "Why should I pay more attention to something that is far away and totally hopeless? I already have enough opportunities to feel angry, depressed and powerless."

Since this is the case, it's clearly a good thing if an appeal to action in support of Palestinian rights is, a) something that is obviously doable by the person asked and, b) comes along with a plausible story for how taking the suggested action will help make the world a better place.

While it won't solve all the problems of human beings on Earth, I claim that going to see the documentary "Budrus," - about the successful nonviolent resistance of Palestinians and Israelis against the route of the Israeli "separation barrier" and its confiscation of Palestinian land in the West Bank village of Budrus - is an action that is within the reach of most literate Americans. I also have a plausible story for how this action would help make the world a better place.

1. This is a feasible action.

The film, which a Washington Post reviewer called "riveting" and "a sure-fire crowd-pleaser," and former American Israel Public Affairs Committee (AIPAC) staffer M.J. Rosenberg called a "totally engaging" story of "regular people" who "take their fate into their own hands," is starting to be shown throughout the United States. In the next two months, scheduled screenings include: Washington DC, through November 11;Chicago, starting November 19; Minneapolis, November 26; Palm Beach, December 1; Boston, December 3; Seattle, December 17.

Tens of millions of Americans live within 50 miles of one of the aforementioned cities; if you happen to be one of them, going to see this movie in the next two months is almost certainly a feasible action for you.

Furthermore, if you don't happen to live in or near a city where there is a screening already scheduled, in the next several months there are still two things that you can feasibly do. One requires just the tiniest smidgen of initiative: you could keep an eye out for when the film is scheduled to show near you. The second requires a slightly higher level of engagement: you could ask yourself, is there a movie theater within 50 miles of me that sometimes shows low-budget movies that have won all kinds of awards? If there is, you could contact that theater and ask them to show it.

2. I have a plausible story that seeing this movie will contribute to making the world a better place.

If many Americans see this movie, it could lead to concrete changes in US policy that would lead to real improvement in the ability of Palestinians in the West Bank to free themselves from the occupation by nonviolent action.

Today, Palestinians and Israelis are using nonviolent resistance to try to defeat the occupation in several villages in the West Bank, but these efforts are much less effective than they could be because they receive very little attention in the U.S. In particular, when the Israeli occupation authorities repress these efforts, it generates no comment in the US media or by the US government. This gives the Israeli occupation authorities a freer hand for repression. And when Palestinians and Israelis see that repression of nonviolent protest generates no U.S. response, that weakens the political case for nonviolent action.

Two months ago, an Israeli military court convicted Abdallah Abu Rahmah of "incitement" for organizing nonviolent protests in Bilin similar to those shown in the movie Budrus, as Ayed Morrar and Ronit Avni of the movie have noted. Abu Rahmah was sentenced to a year in prison.

As I noted at the time of the conviction, while the European Union protested, the U.S. was silent - not just the US government, but also the US media. Of course, the fact that the US media didn't report this event contributed significantly to the fact that the US government didn't feel compelled to respond to it.

Part of the reason that the US media doesn't cover these developments is that, for most of the U.S. news-consuming public, these developments don't have a context. Of course, this is a vicious cycle: the US media doesn't report much on events in the West Bank, so most Americans don't have a context to understand or care about them, which in turn discourages the US media from reporting on events in the West Bank.

But this cycle can be broken. The main political purpose of the Gaza Freedom Flotilla was to call world attention to the Israeli blockade of Gaza. When the Israeli military attacked the flotilla, it was a world-historical event. The flotilla generated press attention to the blockade, but more is true: the renewed press attention to the blockade established context that resulted in increased press coverage of the blockade that made little or no reference to the flotilla. Once the story of the blockade was out, a journalist could write a follow-up story about the blockade that stood a good chance of being printed.

And that's what "Budrus" could do: establish context for an American audience, so that when an Abdullah Abu Rahmah is convicted for protesting, the US media reports on it and the US government feels compelled to respond.

That would be a big change in the world.

But even if "Budrus" doesn't result in this world-historical change, it is likely to result in a smaller change that would still be worth your while.

If you have been following this issue over, say, the last twenty-five years, you know that images of Palestinians and Israelis are used constantly to obstruct people from effectively advocating constructive actions to bring about a just peace: Palestinians support violence. Israelis support the occupation. Palestinians and Israelis can never cooperate or live in peace.

As claims about objective reality, these images are lies, but they retain tremendous power. The situation is far outside the experience of most Americans, and that makes it easier to lie about it and get away with it.

If you watch this movie, you'll be vaccinated against these lies forever.

Furthermore, you'll gain a new superpower: the ability to effortlessly kill these lies on contact. Everyone knows that if someone claims that "Jews are greedy," all you have to do is to produce one example of a Jew who is not greedy and you vanquish their claim. After you see this movie, if someone says: "Palestinians support violence," you'll be able to say: "In Budrus, Palestinians used nonviolence." If someone says: "Israelis support the occupation," you'll be able to say: "In Budrus, Israelis helped defeat the occupation." If someone says, "Palestinians and Israelis will always be at war," you'll be able to say, "In Budrus, Palestinians and Israelis cooperated to defeat the confiscation of Palestinian land."

Wouldn't the acquisition of that superpower be worth the price of one movie ticket?

Holocaust Claims Fraud 2

The business of death

Norman Finkelstein has caused a storm on both sides of the Atlantic and it is not hard to see why: he says the Holocaust has been exploited to extort cash, that most 'survivors' are bogus and that too much money is spent commemorating the Nazi genocide. In the first of two exclusive extracts, he argues that it's time to shut down 'the holocaust industry'

Norman Finkelstein
The Guardian
Wednesday 12 July 2000

Both my father and mother were survivors of the Warsaw Ghetto and the Nazi concentration camps. Apart from my parents, every family member on both sides was exterminated by the Nazis. My earliest memory, so to speak, of the Nazi Holocaust is my mother glued in front of the television watching the trial of Adolf Eichmann (1961) when I came home from school. Although they had been liberated from the camps only 16 years before the trial, an unbridgeable abyss always separated, in my mind, the parents I knew from that . Photographs of my mother's family hung on the living-room wall. I could never quite make sense of my connection with them, let alone conceive what happened.

Apart from this phantom presence, I do not remember the Nazi Holocaust ever intruding on my childhood. I do not recall a single friend (or parent of a friend) asking a single question about what my mother and father endured. This was not a respectful silence.
It was indifference. In this light, one cannot but be sceptical of the outpourings of anguish in later decades, after the Holocaust industry was firmly established.

I sometimes think that American Jewry "discovering" the Nazi Holocaust was worse than its having been forgotten. True, my parents brooded in private; the suffering they endured was not publicly validated. But wasn't that better than the current crass exploitation of Jewish martyrdom? Before the Nazi Holocaust became the Holocaust, only a few scholarly studies (by Raul Hilberg, Viktor Frankl and Ella Lingens-Reiner) were published on the subject.

But this small collection of gems is better than the shelves upon shelves of shlock that now line libraries and bookstores. Both my parents, although daily reliving that past until the day each died, lost interest by the end of their lives in the Holocaust as a public spectacle. One of my father's lifelong friends was a former inmate with him in Auschwitz, a seemingly incorruptible leftwing idealist who on principle refused German compensation after the war.
Eventually he became a director of the Israeli Holocaust museum Yad Vashem. Reluctantly and with genuine disappointment, my father finally admitted that even this man had been corrupted by the Holocaust industry, tailoring his beliefs for power and profit. As the rendering of the Holocaust assumed ever more absurd forms, my mother liked to quote (with intentional irony) Henry Ford: "History is bunk". The tales of "Holocaust survivors" - all concentration camp inmates, all heroes of the resistance - were a special source of wry amusement in my home.

My parents often wondered why I would grow so indignant at the falsification and exploitation of the Nazi genocide. The most obvious answer is that it has been used to justify criminal policies of the Israeli state and US support for these policies. There is a personal motive as well. I do care about the memory of my family's persecution. The current campaign of the Holocaust industry to extort money from Europe in the name of "needy Holocaust victims" has shrunk the moral stature of their martyrdom to that of a Monte Carlo casino.

The Holocaust only emerged in American life after Israel's victory in the 1967 Six Day war against its Arab neighbours. [Since then] too many public and private resources have been invested in memorialising the Nazi genocide. Most of the output is worthless, a tribute not to Jewish suffering but to Jewish aggrandisement. The Holocaust has proven to be an indispensable ideological weapon. Through its deployment, one of the world's most formidable military powers, with a horrendous human rights record, has cast itself as a "victim" state, and the most successful ethnic group in the US has likewise acquired victim status. Considerable dividends accrue from this specious victimhood - in particular, immunity to criticism, however justified.

The time is long past to open our hearts to the rest of humanity's sufferings. This was the main lesson my mother imparted. I never once heard her say: "Do not compare." My mother always compared. In the face of the sufferings of African-Americans, Vietnamese and Palestinians, my mother's credo always was: "We are all holocaust victims."

The term "Holocaust survivor" originally designated those who suf fered the unique trauma of the Jewish ghettos, concentration camps and slave labour camps, often in sequence. The figure for these Holocaust survivors at war's end is generally put at some 100,000. The number of living survivors cannot be more than a quarter of this figure now. Because enduring the camps became a crown of martyrdom, many Jews who spent the war elsewhere represented themselves as camp survivors. Another strong motive behind this misrepresentation, however, was material. The postwar German government provided compensation to Jews who had been in ghettos or camps. Many Jews fabricated their pasts to meet this eligibility requirement. "If everyone who claims to be a survivor actually is one," my mother used to exclaim, "who did Hitler kill?"

Even within the Holocaust industry, Deborah Lipstadt, for example, wryly observes that Holocaust survivors frequently maintain they were personally examined by Josef Mengele at Auschwitz. Because survivors are now revered as secular saints, one doesn't dare question them. Preposterous statements pass without comment. Elie Wiesel reminisces in his acclaimed memoir that, recently liberated from Buchenwald and only 18 years old, "I read the Critique of Pure Reason - don't laugh! - in Yiddish." Leaving aside Wiesel's acknowledgment that at the time "I was wholly ignorant of Yiddish grammar," The Critique of Pure Reason was never translated into Yiddish. "The truth I present is unvarnished," Wiesel sighs, "I cannot do otherwise."

In recent years, "Holocaust survivor" has been redefined to designate not only those who endured but also those who managed to evade the Nazis. One contributor to a Holocaust website maintained that, although he spent the war in Tel Aviv, he was a Holocaust survivor because his grandmother died in Auschwitz. According to Israel Gutman, a former inmate of Auschwitz, director of Yad Vashem and a Holocaust lecturer at Hebrew University, "it's not that important" whether Binjamin Wilkomirski's [now discredited "autobiographical" account of childhood in the camps], Fragments, is a fraud. "Wilkomirski has written a story which he has experienced deeply; that's for sure . . . He is not a fake. He is someone who lives this story very deeply in his soul." So it doesn't matter whether he spent the war in a concentration camp or a Swiss chalet; Wilkomirski is a Holocaust survivor because "his pain is authentic."

The Israeli prime minister's office recently put the number of "living Holocaust survivors" at nearly a million. The main motive behind this inflationary revision is again not hard to find. It is difficult to press massive new claims for reparations if only a handful of Holocaust survivors are still alive.

In the early 1950s, Germany entered into negotiations with Jewish institutions and signed indemnification agreements. It has paid out to date some $60bn. The German government also negotiated a financial settlement with the Conference on Jewish Material Claims Against Germany, an umbrella of major Jewish organisations including the American Jewish Committee, American Jewish Congress, B'nai B'rith, the Joint Distribution Committee. The claims conference was supposed to use the monies, $10m annually for 12 years, or about a billion dollars in current values, for Jewish victims of Nazi persecution who had fallen through the cracks in the compensation process. My mother was a case in point. A survivor of the Warsaw Ghetto, Majdanek concentration camp and slave labour camps at Czestochowa and Skarszysko-Kamiena, she received only $3,500 in compensation from the German government.
Other Jewish victims (and many who in fact were not victims), however, received lifetime pensions from Germany, eventually totalling hundreds of thousands of dollars. In a flagrant breach of its letter and spirit, the conference earmarked the monies not for the rehabilitation of Jewish victims who had received minimal compensation but for the rehabilitation of Jewish "communities". Indeed, a guiding principle of the claims conference prohibited use of monies for "direct allocations to individuals".

In a classic instance of looking after one's own, however, the conference provided exemptions for two categories of victims: rabbis and "outstanding Jewish leaders" received individual payments. As the conference came under attack from defrauded Jews, Rabbi Arthur Hertzberg cast a plague on both sides, sneering that: "It's not about justice, it's a fight for money." When Germans or Swiss refuse to pay compensation, the heavens cannot contain the righteous indignation of organised American Jewry. But when Jewish elites rob Jewish survivors, no ethical issues arise: it's just about money.

Others involved in the reparations process have also done well. The reported annual salary of Saul Kagan, long-time executive secretary of the claims conference, is $105,000. Kagan rings up in 12 days what my mother received for suffering six years of Nazi persecution.

In recent years, the Holocaust industry has become an outright extortion racket. Purporting to represent all of world Jewry, living and dead, it is laying claim to Holocaust-era Jewish assets throughout Europe.Fittingly dubbed the "last chapter of the Holocaust", this double shakedown of European countries as well as legitimate Jewish claimants first targeted Switzerland. [After a protracted campaign which enlisted the American political establishment] the Swiss finally caved in 1998 and agreed to pay $1.25bn. "The aim ..." a Swiss bank's press release read, "is to avert the threat of sanctions as well as long and costly court proceedings."

Its solicitude for "needy Holocaust survivors" notwithstanding, the World Jewish Congress wants nearly half the Swiss monies earmarked for Jewish organisations and "Holocaust education". The Simon Wiesenthal Centre maintains that if "worthy" Jewish organisations receive monies, "a portion should go to Jewish educational centres". As they "angle" for a bigger share of the loot, reform and orthodox organisations each claim that the 6m dead would have preferred their branch of Judaism as financial beneficiary.

Meanwhile, the Holocaust industry forced Switzerland into a settlement because time was allegedly of the essence: "Needy Holocaust survivors are dying every day." Once the Swiss signed away the money, however, the urgency miraculously passed. More than a year after the settlement was reached there was still no distribution plan. By the time the money is finally divvied out, all the "needy Holocaust survivors" will probably be dead. In fact, by last December, less than half of the $200m "Special Fund for Needy Victims of the Holocaust" established in February 1997 had been distributed to actual victims. After lawyers' fees have been paid, [total attorney fee demands for the case run to $15m] the Swiss monies will then flow into the coffers of "worthy" Jewish organisations.

The staggering dimensions of Hitler's Final Solution are by now well known. And isn't the "normal" history of humankind replete with horrifying chapters of inhumanity? A crime need not be aberrant to warrant atonement. The challenge today is to restore the Nazi Holocaust as a rational subject of inquiry. Only then can we really learn from it. The abnormality of the Nazi Holocaust springs not from the event itself but from the exploitative industry that has grown up around it.

The Holocaust industry has always been bankrupt. What remains is to openly declare it so. The time is long past to put it out of business. The noblest gesture for those who perished is to preserve their memory, learn from their suffering and let them, finally, rest in peace.

Finkelstein on ...

The Simon Wiesenthal CentreL: "The Centre is renowned for its 'Dachau-meets-Disneyland' museum exhibits and 'the successful use of sensationalistic scare tactics for fund-raising'."

Daniel Goldhagen, author of Hitler's Willing Executioners: "Although bearing the apparatus of an academic study, Hitler's Willing Executioners amounts to little more than a compendium of sadistic violence ... Replete with gross misrepresentations of source material and internal contradictions, Hitler's Willing Executioners is devoid of scholarly value."

Deborah Lipstadt, the Holocaust scholar who was unsuccessfully sued for libel by David Irving: "To document widespread Holocaust denial, Lipstadt cites a handful of crank publications. Her pièce de résistance comes from Arthur Butz, a nonentity who teaches electrical engineering."

David Irving, historian and Holocaust revisionist: "Irving, notorious as an admirer of Hitler and sympathiser with German national socialism, has nevertheless made an 'indispensable' contribution to our knowledge of World War II."

Elie Wiesel, Nobel laureate and Holocaust survivor: "Elie Wiesel's performance as official interpreter of the Holocaust is not happenstance. Plainly he did not come to this position on account of his humanitarian commitments or literary talents. Rather, Wiesel plays this leading role because he unerringly articulates the dogmas of, and accordingly sustains the interests underpinning, the Holocaust."

America's giant Holocaust claims fraud - more than just a blip?

The scam that defrauded the conference of $43 million earmarked for Holocaust survivors was not just a matter of a few bad apples.

By Anshel Pfeffer

You could almost say it was a crime without victims. Sure, $43 million were stolen over the last 16 years through false claims submitted to two funds run by the Claims Conference, the main organization that administers reparations to Jewish Holocaust survivors. And granted, six present and former employees of the organization were at the center of the scam, including the man in charge of overseeing both funds.

But hey, according to Greg Schneider, executive vice president of the Claims Conference, "it's less than one percent of funds distributed under those programs" and no authentic Holocaust survivor received less because of the scam. Well, that's okay then.

swastika - Reuters - November 8 2010

And of course, no one is saying this on the record, but most of the money came from the German taxpayer. So don't expect any official recriminations from that quarter.

The Manhattan district attorney was full of praise for the Claims Conference's cooperation in the investigation, saying without its help "in ferreting out this alleged scheme to defraud them, it never would have been exposed." So now the conference will hire an international consulting firm to help it strengthen its anti-fraud measures and everything will be fine. We should have no worries about allowing the conference to remain the Jewish people's sole custodian not only of official reparations from the German government, but also of property confiscated from Jews by the Nazis in former East Germany and other countries, and recently for stolen art treasures as well.

But just a moment. Six employees may seem a small number in a large multinational company or a government agency, but less than 100 people work at the Claims Conference's headquarters in New York, where all the suspects were employed. So even assuming that no other employee was tainted by the corruption, this was not just a matter of a couple of rotten apples; it was a sizable group operating within the organization for 16 years. Sixteen years!

And it doesn't even seem like the fraud was that elaborate. Indeed, it was almost wholesale - 4,957 false one-time payments and 658 fake pension claims.

The conference claims in its defense that this is but a drop in the ocean when compared to the number of recipients to whom it has made payments over the years, over 600,000. But if 5,615 claims were so easily fabricated, who knows how many other thousands of fake Holocaust survivors have been collecting payments over the years? I can't even bear to check the Holocaust denial websites to see how they must be crowing right now.

It would be easy to simply blame the conference for incompetence. But that is only a small part of the problem. The organization has no lack of impressive professionals. For example, Reuven Merhav, the chairman of its executive committee, is a former senior Mossad official, ambassador and director general of the Israeli Foreign Ministry, whose investigative skills were at least sufficient to make him a member of the Turkel Committee that is now investigating May's botched raid on a Gaza-bound flotilla. (Justice Jacob Turkel, the eponymous committee's head, is another Claims Conference director. )

No, the real problem at the Claims Conference seems to have been complacency. From various hints and off-the-record remarks to the press, you get the impression that conference leaders are trying to blame Russian organized crime. Apparently all those indicted had links to the group in Brooklyn's Brighton Beach that ran the operation.

That may well be true. But how does that exonerate the senior executives who allowed members of this gang to serve in positions where they authorized hundreds of millions of dollars a year in payments? Were there no serious background checks?

The conference is nominally accountable to a board of directors representing 25 Jewish organizations from around the world, some of them large and influential, others archaic and unrepresentative of any real Jewish constituency. But what interest do any of these directors have in demanding a comprehensive overhaul of how the conference does business or appointing an external committee to review this latest scandal?

In addition to the money going to survivors, the conference distributes tens of millions of dollars annually to a long list of organizations loosely involved in Holocaust commemoration and education. Many of these institutions are subsidiaries of the organizations represented on Claims Conference board of directors. They are not interested in altering this cozy arrangement, despite claims by survivors' groups that in the final years of survivors' lives, every spare cent should be going to their welfare.

One former director did dare to break ranks: Zeev Bielski, the previous Jewish Agency chairman, demanded answers to some uncomfortable questions. When he did not receive them, he launched an independent audit of his own, revealing to the press that the conference had over $1 billion of liquid assets in reserve.

He also argued that Israel, as home to the majority of living survivors, should have more of a say in how the New York-based organization allocates funds. This, of course, was a grave breach of protocol, and the cash-strapped agency was punished: Funds for its projects were withheld. Bielski was forced to back down with a groveling apology. Others learned the lesson.

The Claims Conference is the richest, most powerful and least answerable old-boys network in the Jewish world. Yet it is entrusted not only with billions of dollars, but with a duty to the welfare of Holocaust survivors worldwide until the end of their days. And no amount of scandal, media exposes and political pressure is about to change that.

*Blowback. The Costs and Consequences of American Empire. Chalmers Johnson.

*Overthrow. America's Century of Regime Change from Hawaii to Iraq. Stephen Kinzer.

*Devil's Game. How the United States Helped Unleash Fundamentalist Islam. Robert Dreyfuss.

*Imperial Overstretch. Roger Burbach & Jim Tarbell.

*Imperial Hubris. Why the West Is Losing The War on Terror. Michael Scheuer.

*Killing Hope. William Blum.

*Failed States. The Abuse of Power and the Assault on Democracy. Noam Chomsky.

*Iran. A People Interrupted. Hamid Dabashi.

*Treachurous Alliance. The Secret Dealings of Israel, Iran, and the U.S. Trita Parsi.

there is an unwriten chapter in the history of the Cold War and the New World Order that followed. It is the story of how the United States -- sometimes overtly, sometimes covertly -- funded and encouraged right-wing Islamist activism. Devil's Game attempts to fill in that vital missing link... There is no question that the U.S. support for the mujahideen, most of which went to the hard-core Islamists, was a catastrophic miscalculation. It devastated Afghanistan itself, led to the collapse of its government, and gave rise to a landscape dominated by warlords, both Islamists and otherwise. It created a worldwide network of highly trained Islamist fighters from a score of countgries, linked together and roughly affiliated to Osama bin Laden's soon-to-be established Al Qaeda organization.

Schuldvraag Dit soort ongerijmdheden negeren we liever.
http://www.volkskrant.nl/vk/nl/2664/Nieuws/article/detail/971934/2010/01/06/Moslim-terrorisme-een-gevolg-op-zoek-naar-een-oorzaak.dhtml

Ongerijmdheden?

http://www.katholieknederland.nl/abc/detail_objectID585159.html

The Maxim Gun

The Maxim Gun, and they have not.' Eerst even een korte aanloop.

Bank of America Is in Deep Trouble and There May Be Financial Disaster on the Horizon

Its stock value has dropped 40 percent since April, and the bank is mum on what losses it's hiding on its $2.3 trillion balance sheet.

Will Bank of America be the first Wall Street giant to once again point a gun to its own head, telling us it'll crash and burn and take down the financial system if we don’t pony up for another massive bailout?

When former Treasury Secretary Hank Paulson was handing out trillions to Wall Street, BofA collected $45 billion from the Troubled Asset Relief Program (TARP) to stabilize its balance sheet. It was spun as a success story -- a rebuke of those who urged the banks be put into receivership -- when the behemoth “paid back” the cash last December. But the bank’s stock price has fallen by more than 40 percent since mid-April, and the value of its outstanding stock is currently at around half of what it should be based on its “book value” -- what the company says its holdings are worth.

“The problem for anyone trying to analyze Bank of America’s $2.3 trillion balance sheet,” wrote Bloomberg columnist Jonathan Weil, “is that it’s largely impenetrable.” Nobody really knows the true values of the assets these companies are holding, which has been the case ever since the collapse. But according to Weil, some of BofA’s financial statements “are so delusional that they invite laughter.”

Weil points to the firm’s accounting of its purchase of Countrywide Financial -- the criminal enterprise at the center of the sub-prime securitization market. Bank of America, Weil notes, hasn’t written off Countrywide’s entire value. “In its latest quarterly report with the SEC,” he wrote, “Bank of America said it had determined the asset wasn’t impaired. It might as well be telling the public not to believe any of the numbers on its financial statements.”

With investors valuing BofA at half the worth that the bank claims, it’s one titan of Wall Street that may be on the brink of collapse. But it’s not alone. “Everybody was doing this, this is not just something that Countrywide and Bank of America were doing," legendary investor Jim Rogers told CNBC. As a result, the banks’ balance sheets are "full of rotten stuff" that “is going to be a huge mess for a long time to come.”

And that “rotten stuff” will continue to be a drag on the brick-and-mortar economy until the mess gets cleaned up. Which, in turn, is a powerful argument for a second dip into the public trough.

When the financial crisis hit, those of us who view the free market as more than a hollow slogan urged the government to take over the ailing giants of Wall Street, wipe out their investors, send their parasitic management teams to the unemployment line and gradually unwind the huge pile of “toxic” assets that they’d amassed before selling them back, leaner and meaner, to the private sector.

It worked in the past -- it was Ronald Reagan’s response to the Savings and Loan crisis of the 1980s. But that was then, and today Reaganite policies are deemed to be “creeping socialism” -- thoroughly unacceptable. We were told the banks were too big to fail, and Bush saw eye-to-eye with Republicans and Blue Dogs in Congress and bailed the banks out without exacting a penalty in exchange for the taxpayers' largesse. They socialized the risk, but the financial industry went right back to its old tricks, paying its execs fat bonuses and playing fast and loose with its accounting.

Much of that toxic paper remains on their books -- somewhere. The assets are still impossible to price and now several Wall Street titans appear to be approaching a tipping point, poised to once again to extort a mountain of cash from our Treasury by claiming to be too big -- and interconnected -- to crash and burn as the principles of the free market would otherwise dictate.

But there’s a difference between then and now. At the time, most of us saw the crash as a result of hubris and greed run amok in an under-regulated financial sector. Now, we know the financial crisis was the result of unchecked criminality -- that fraud was perpetrated, in the words of University of Missouri scholar (and veteran regulator) William Black, “at every step in the home finance food chain.” As Black and economist L. Randall Wray wrote recently:

The appraisers were paid to overvalue real estate; mortgage brokers were paid to induce borrowers to accept loan terms they could not possibly afford; loan applications overstated the borrowers' incomes; speculators lied when they claimed that six different homes were their principal dwelling; mortgage securitizers made false [representations] and warranties about the quality of the packaged loans; credit ratings agencies were overpaid to overrate the securities sold on to investors; and investment banks stuffed collateralized debt obligations with toxic securities that were handpicked by hedge fund managers to ensure they would self destruct.

That homeowners would default on the nonprime mortgages was a foregone conclusion throughout the industry -- indeed, it was the desired outcome. This was something the lending side knew, but which few on the borrowing side could have realized.

And since the crash, they’ve committed widespread foreclosure fraud, dutifully whitewashed by the corporate media as nothing more than some “paperwork” problems resulting from a handful of “errors.”

It is anything but. As Yves Smith, author of Econned: How Unenlightened Self-Interest Undermined Democracy and Corrupted Capitalism, wrote in the New York Times, “The major banks and their agents have for years taken shortcuts with their mortgage securitization documents — and not due to a momentary lack of attention, but as part of a systematic approach to save money and increase profits.”

Increasingly, homeowners being foreclosed on are correctly demanding that servicers prove that the trust that is trying to foreclose actually has the right to do so. Problems with the mishandling of the loans have been compounded by the Mortgage Electronic Registration System, an electronic lien-registry service that was set up by the banks. While a standardized, centralized database was a good idea in theory, MERS has been widely accused of sloppy practices and is increasingly facing legal challenges.

Judges are beginning to demand that the banks show their work -- prove they have the right to foreclose -- and in many instances they can’t, having sliced and diced those mortgages up into a thousand securities without bothering to verify the paperwork as most states require by law. This leaves what Smith calls a “cloud of uncertainty” hanging over trillions in mortgage-backed securities -- the largest class of assets in the world -- and preventing a real recovery of the housing market. In turn, that is holding back the economy at large; according to the International Monetary Fund, it’s the drag of the housing mess that’s causing the high and sustained levels of unemployment we see today.

Big financial firms have also been cooking their books in order to obscure how shaky their balance sheets really are because honest accounting would likely bring an end to those big bonuses that drive “the Street.” Yet a day of reckoning may be fast approaching.

If the worst-case scenario should come to pass, with the banks hit by thousands of lawsuits, unable to foreclose on properties in default and with investors running for the hills, expect to hear calls for TARP II. It’d be a very heavy political lift, but given Congress’s fealty to Wall Street it could plausibly be passed.

There are alternatives. As in 2008, the federal government could put failing financial institutions into receivership. But some experts are saying that if we want to get off the roller coaster of an economy moving from one financial bubble to the next, a bolder approach is necessary: permanent nationalization of banks that can’t survive without public dollars.

“Inevitably, American taxpayers are going to pick up much of the tab for the banks' failures,” wrote Nobel prize-winning economist Joseph Stiglitz last year. “The question facing us is, to what extent do we participate in the upside return?” Stiglitz argued that the government should take “over those banks that cannot assemble enough capital through private sources to survive without government assistance.”

To be sure, shareholders and bondholders will lose out, but their gains under the current regime come at the expense of taxpayers. In the good years, they were rewarded for their risk-taking. Ownership cannot be a one-sided bet.

Of course, most of the employees will remain, and even much of the management. What then is the difference? The difference is that now, the incentives of the banks can be aligned better with those of the country. And it is in the national interest that prudent lending be restarted.

Leo Panitch, a professor of comparative political economy at Canada’s York University, wrote that "the prospect of turning banking into a public utility might be seen as laying the groundwork for the democratization of the economy.”

Ellen Brown, author of Web of Debt, points to the success of the nation’s only government-owned bank, the Bank of North Dakota. “Last year,” she wrote, “North Dakota had the largest budget surplus it had ever had…and it was the only state that was actually adding jobs when others were losing them.”

North Dakota has an abundance of natural resources, including oil, but as Brown notes, other states that enjoy similar riches were deep in the red. “The sole truly distinguishing feature of North Dakota seems to be that it has managed to avoid the Wall Street credit freeze by owning and operating its own bank.” She adds that the bank serves the community, making “low-interest loans to students, farmers and businesses; underwrit[ing] municipal bonds; and serv[ing] as the state’s 'Mini Fed,' providing liquidity and clearing checks for more than 100 banks around the state.”

Several states have considered proposals to emulate North Dakota, but such a bold move would obviously be all but impossible in Washington. But it shouldn’t be off the table. Banks provide an “intermediary good” to the economy, creating no real value. But Big Finance’s speculation economy has caused great and real pain for the rest of us. As Joe Stiglitz put it, there’s no reason in the world the incentives of the banks shouldn’t be better aligned with the interests of the country and its citizens.
